Requirements for IRP - Texas

    We are a husband/wife LLC. Have been running under another company's authority over 3 years - have our own truck. Until now, he drives (30+ yrs experience) and I ride. Now I also have CDL. So we're getting our own authority and will team drive with our truck doing power only, then buy a flat bed when the time is right.

    Now we have USDOT and MC #s. got insurance, BOC-3, UCR, and will take care of all other requirements on the list. I know it won't actually be "active" till all our paperwork is filed and approved.

    My question is this - I got all the forms for getting our apportioned plates (IRP) to run interstate loads. We're based in Texas (lived there all our lives). Our business address, however, is a virtual mailbox - which is fine for the LLC and mail processing and we have our "registered agent" there. It IS a physical structure, but we don't "rent/lease" it - just pay for mail processing and registered agent service.

    We "live in the truck" as of February and have no business office i.e. "physical structure" or "residence" proof. We stay at family's home and store our car there and have mail forwarded to a po box there on our "off work" time - a week or less every other month.

    The proof of business address/office or proof of residence (with utility bills or such) is a hurdle I'm not sure how to jump over.

    Any suggestions? I've considered asking my family to sign (notarized) rental agreement for a proof of residence (as long as that doesn't affect their taxes - retired couple). That is the town where all our files are kept in storage - other than what I keep current in the truck.

    The regional office to file all the paperwork in Texas would be two different choices if we use our "business address" versus the "residential" address. So not sure where to even get the account set up to file.

    I don't get the LLC thing, are you configured as an S-corp or a sole proprietor?

    See if the truck and authority is under a business entity (of any sort), the IRP and registration all has to also be under that entity.

    You should rent office space at one of those shared location setups where you can use that address because that should be a legal requirement for any state since 2001.

    We file as an S-corp. We have a legal address filed with the SOS of Texas. Have had that address changed filed/approved since February this year. We filed our business address at our home/residence prior to that.

    The requirements on the website and forms state the business has to show proof of lease or rent type ownership at the office address. We get all our business paperwork through this address and it IS a building. Is that considered a "shared office space" since we have our registered agent there to receive "signature required" or legal paperwork?

    Then it is simple, lease one square foot at that location, most owners will work with you.

    It is not possible to lease any office space at our mail service / registered agent. So, I have to find another way to establish a business location or proof of residency. We have our address on CDLs, personal car titled and insurance, voter id, a few other bills associated with my parents' address. It seems the requirements for "proof" have to do with just getting an account with the regional dmv office - not the actual address on the IRP etc. I say this because of the options to use a residence as the "place of business." See the form I've attached.

    So, if I have a "rental agreement" with my parents since we stay there during our time off, maybe that would suffice to get the account established.

    We are going through the exact same thing with Texas's address merry-go-round. My wife was on hold with the Beaumont office for over 2 hours yesterday. If we figure out any more details, I'll post them here.

    Like another poster said rent a shared office space. Since you don’t need an office it’s less than $100 a month. When dot comes to inspect your paperwork for your new authority you can meet at your shared office space.

    IFTA is taking forever because of Covid. Plan on buying a lot of trip permits.

    Thank you, people make this so difficult when they want to have a virtual business location while there are thousands of places to rent space. People don’t want to try to look, they want an easy solution.

    I know of one o/o who rents 15 sq ft at a subway place for $100 a month. He has one filing cabinet, one little dock desk (this is a desk that you stand at) and a power outlet for their phone in the space. He will visit that space at least once a quarter to pick up mail that hasn’t been forwarded to him, file paper work that has been scanned to make it official. He has not had an issue with the texas irp or anything else doing this. The dot audit took place at a different location when the inspector found out what the amount of space they rented because there is no legal space requirements for any business like this.

    This isn’t uncommon practice.

    You have LLC with Texas on file... that is the first section checked

    Sign a lease a agreement with your parents in Texas and change the address on your CDL to that address that tick both second block requirements.

    The third section you can use your Texas drivers lic. Again and then go pick up one of your parent utility bills ASAP as a form of paying their rent... like the water bill. Go down and switch it in your name and ask for a statement with you on it with that address.

    Double check the LLC address may have to match the lease address so double check that.

    Put it all in a package with the apportioned forms and hand carry it to your regional office and drop it off. They claim two days processing but it took longer. Make sure you just use legible copies and not originals... you won’t get your paperwork back.
