It's an interesting idea to put a confidentiality clause in there just like the no-compete clause.

Not sure how I feel about this. On one hand I'd like to see more of the money get passed to the Carrier but on the other hand I hate to the Feds get any more involved in business dealing at all.

I have read somewhere there is already law regarding the broker being transparent and sharing the particulars including the amount of the load pay. I believe it was on here, actually. I think I got an email from the trucker news part.

There is a law but in the broker agreements they require that you waive your right to see that.

As it stands, either wave your right or they will Blacklist you and you won't work for them ever again.

Or any other broker for that matter because 100% of them require you to wave that.

I guess that makes sense. In that article though, that owner operator who did have his own authority I suppose wouldn't haul for any broker who wouldn't be transparent. I do remember reading that. He even took one of the brokers customers as a direct customer. Bet that broker cried in his milk after that incident.

FYI, in my world I don't have a single contract with that clause in it and I've only seen about two in over two years that did have it. I pull open deck and end dump.

Contracts are negotiable. If the other party refuses to adjust anything at all then RUN from them. I just signed a new one yesterday. They wanted NET45 payment terms. I got it changed to NET30.

They also wanted to pay ACH but there was verbiage giving them the right to withdraw in case of an, "error". I removed the withdraw part from the contract after they agreed and I had them sign it all afterwards and return to me. Everything is negotiable.
