Making your own agreements for broker

    A quick search I could not find it anywhere in print.

    How old is that book? Are all of the laws still relevant today?

    It’s really not that serious. But I will mark out things on the rate sheet if I need to. Like if there is a strict appointment time on the rate sheet, but we agreed to an open window delivery, I’ll cross it out and put 8-3pm “as discussed”...

    Me too, the one site where you can buy it said it was an unsecure site. Sounds like an interesting read. I think I'll just call their office directly to see if it can be ordered.

    The reason for this thread and the problem with all of this is that is very serious.

    As long as everything falls into place and everything is okay and rolls right along you won't have any problem.

    Now I have one company that one f up after another f up I was under their load for almost a week.

    It must have been their f up because the broker was crying he has to pay for this out of his own pocket and now it looks like he's not going to pay for it at all.

    Maybe they will maybe they won't I can't tell at this point.

    Tomorrow we are going into the third week that I can't get ahold of the broker, the accessories for the load have not been approved, the payment is not being processed, so it's anyone's guess. Although the rep tells me it is in "payment pending" status which to me is meaningless.

    To me that just means they may or may not get to it at some point.

    Yes they have a 97 credit rating and yes I worked for them before and they paid me relatively quickly.

    Based on those two things I would never have dreamt I would have a problem with this company.

    Everything can roll along really smooth but when you hit a problem it's all in their favor.

    Like agreeing to arbitration or agreeing to court cases to be in their state instead of yours.

    Like if it is an intrastate load, you have few options.

    Trying to figure out how not just myself but how all of us or more of us can be better protected and still be able to get work.

    Not at all that I want to, but I'm even beginning to consider finding one or two direct customers to cut down on the broker nonsense.

    Not really something I'm looking forward to, but I am beginning to consider it.

    For me, by staying in my lane and not venturing too far outside of it. Everyone has their own priorities. Chasing rates all over the country isn't one of mine.

    What I've discovered is that certain brokers, or bigger carriers who have their own brokerage divisions, do a lot of contract freight with the same shippers over and over again.

    Contract freight that I could never secure as a one man operation. The one's (broker agents) I've established a relationship are generally fair, easy to deal with and always pay.

    All the accessory pay, additions, etc, are something I really don't have to deal with anyways to be honest.

    I guess ever residential contract I’ve ever signed where I’ve had to make changes has also needed initials anywhere a change was made so both parties understood what they were signing & what changes were being made so no one could get the information swept under the table.

    I hear you. But you know how it goes. We would have to collectively form a union of some kind to put enough pressure on brokerages to accept it. Even then, they would probably just choose not to do business with our union.

    once you get to crossing out on carrier packs, which most are digital now and you can’t scratch anything out on, they just won’t do business with you.

    If you want to control all the variables you pretty much do have to go direct.

    until then, no TQL, no coyote, no CH Robinson and etc

    Well that's what I'm trying to figure out.

    Some members say that they successfully do that.

    I just don't know what broker's you can get away with doing that and which ones you can't.

    And I don't know if some of these guys do specialized Freight or if it's just general Freight and they can make more of their own terms.

    If I can't at least hedge my bets that I'll get paid, I'm going to have to move into some type of a direct situation at some point in the future.

    How can you really feel secure earning your income when you know that if there is a problem they can just simply not pay you and just about get away with it?

    And mostly because they had you sign your own rights away.

    If what everyone is saying is true why don’t you just cross the rate out and up it and hole for the best....lol

    Well I'm trying to get more information because I have written up my own agreement but I'd really like to hear more from other people that have actually done that and how they go about it.

    I'm sure there's going to be some trial-and-error but really who wants to sign an agreement that if they decide not to pay you they basically don't have to?
