Using vacation time before quitting - Also, Prorated Vacation Time Policy?

    When quitting a company, has anybody used up their vacation time at the start of the year and then quit/put in your 2 weeks notice? Did the company take back your vacation time because of a "prorated vacation policy"?

    I don't think my company has a prorated vacation policy because the policy is after 1 year you get 1 week vacation, after 2 years you get 2 years vacation. I started January 2019 and couldn't use my 1 week vacation until January 2020 - If this was a prorated vacation policy, then in theory I should've been able to use my 1 week vacation immediately when I first got hired in January 2019, instead of having to wait 1 year, right?

    That said, I'm still a bit nervous about using vacation time before quitting and the company saying that I "owe them" from using my vacation. Then it'll be just time wasted the last month or so with the company when I could just quit earlier and get the surgery that I need to get over and done with quicker, rather than driving in winter January for nothing if they say I "owe them" for using my vacation before quitting.

    Anybody used vacation time before quitting?

    100% depends on the company. It's an impossible question to answer without knowing which company, and in some cases which terminal.

    For example, at work our vacation is accrued on our anniversary date and it's 100%. That's at our terminal because that's what our contact states. That's not the case in every terminal in our company.

    I think some basic common sense can be applied here. If you drive for a carrier that pays vacation time that question is self-evident. If you take a vacation then get paid for that time, what is the carrier going to do? Demand the money back? If they try to dock the last check to reimburse for that pay, this most likely is illegal, not only can you get this money back plus damages you can also in some cases get attorney fees paid as well. . However, if this time is "in the bank" I would suggest using it WELL BEFORE turning in a notice.

    I never heard of prorated vacation. You earn your vacation time by working the first year. They you can take it anytime you want.

    Get all of your vacation time approved.

    Use it all....
    They will come get the truck eventually.

    Don't say anything about quitting until your dispatcher calls you asking where you are at.

    I've been there done that. That's how I did it.

    If you really want to screw them say you are under quarantine..... The employer must pay you if you are off 3 consecutive weeks (without using PTO)
    2/3 your average pay cheque.

    ....if you are taking care of your kids for a bonafide need...aka homeschooling....they must pay you for either 8 weeks or 10 weeks at that reduced pay.

    ....it was something trump did but noone paid attention to it.

    .....I took advantage of both of those on my last employer....

    Know the game or get played.
