Accident with another driver with very low liability payout.

    So my friend from Idaho had a pickup pull out in front of him a few months ago and he hit it. The state trooper said it was the other guys fault, also it was caught on dash cam and was obviously the guys fault in the pickup. The guy had Geico insurance with liability coverage of $25,000.

    Both vehicles were totaled out. Nobody badly hurt thankfully, however Geico refuses to pay more than their $25,000 even though the truck is obviously worth more. They paid it off which was right at the $25,000 and now my friend is hung out with no extra money for a down payment for a different truck or any more help.

    He talked to a lawyer, but the guy at fault is a 40 year old stay at home guy who didn’t even own the pickup and has no money or income. Basically just a couch potato.

    This really concerns me since it wasn’t my friends fault and I don’t want it to happen to me. Have y’all ever heard of this happening??

    Did your friend have just liability on his vehicle, or collision coverage? I think not positive..if he did his insurance should pick up the difference on what he had coverage amount at. Or close to that. If he had liability then he is stuck holding the bag. Option is to sue them, but like you say they have nothing cant get blood out of a turnip. Even if a person has say an old vehicle insured for 50k and its only worth 20k and it gets totaled. Insurance only has to pay you the value. Or replace of like value. They will sometimes take into consideration its condition, mint, poor etc. That may help on your settlement. I am no expert on this, just what I've learned in time being involved in 2 no faults. One in 1988 and one in 2011.

    It sounds like your friend only had Liability insurance. Is this correct or did he have full coverage? Because, if he had full coverage his insurance company may give him what the truck is worth, then go after Gieco. Sometimes, you may think the truck is worth more, but it is actually not. I am not saying that is the case, it is just something to think about. Also there is an appeals process with the insurance company. Also aberration may be an option.

    Do like me, quit driving altogether. Hey, these multi car pileups cost the insurance companies plenty, not that I'm crying for them, but got to cut corners somewhere else. Nothing but horror stories from people getting bilked by these companies, and it goes on and on. Really, if possible, limit your driving to 2 miles to Walmart,and park it in the drive. What's the worst that could happen?

    Don't we wish at times could just quit? Well it would work for some, unfortunately not all in retirement yet. Even wal-mart has stock to be replenished. Know what your saying though. Some of the state minimum insurance requirements wouldn't even cover the wheel hub on a old farm wagon. Guess they want folks to obtain a vehicle, get out there and burn gas. Some of these people can't afford crap, dont own a pot to #iss in or a window to throw it out of, but they are out on the roads, so dumb they should be walking or taking the local bus. Then when they cause a accident its like wow did i do that. It really is screwed up. Be careful, drive defensively, quick reflexes, good brakes, prayer, and great insurance on your vehicle. Have to cover the uninsured and the under underinsured.

    Was this friend's truck a Class 8 or a pickup truck? Depending on which it is can get a different answer.

    Bottom line is..the guy at fault had 25k liability..( lucky he even had that, probably above state minimum)..they paid that amount to the other party. They're done. So what could be different? Class 8 or personal 4- wheeler? Up to the not at fault driver's insurance to make them whole, if need be. Geico says bye bye, good luck.

    Ya it was a semi truck. Thankfully his flatbed trailer was fine. He has full coverage with Progressive but they haven’t acted like they are going to help so far.

    My point about the difference in what type vehicle was your friends insurance requirements. If he had been in a truck stop and some one in the middle of the night had torn the truck up to the point it was totaled, and the other vehicle just drove off, his insurance would have paid, had he any type of comprehensive coverage.
