Alcohol based mouthwash

I remember that when a CHP officer came to my driver's ed. class in high school, he had a student swish with mouth wash. The student blew a .06 on the officer's breathalyzer, and then proceeded to do the required 15 min field sobriety test. After the field sobriety test, the student had no alcohol on his breath.

 

We had a judge here in Albany,NY he turned to avoid a DWI check point (claims he was NOT drinking) his attorney said he had just left his house and had indeed used mouth wash, the attorney LIVE on tv showed the reporter how actually using mouthwash can indeed make your BAC jump to where it looks like your DWI. It was amazing, But the judge was drunk, he pled guilty to a lesser charge ( go figure ). and that was on a judge, figure just a average driver,,, is anyone ready to catch a few books there going to throw at you in court?????

 

as i said an intoxilizer which is what you will take when you go to their office not the store down the street as far as the PBT machine( the handheld on the side of the road) they are not admissable in court and any officer trained to use one will take 3 readings 5 minutes apart if it registers alcohol and you tell them you just took a swig of mouthwash. also if you tell the officer that you just had an alcohol drink he will test you again in 30 min to make sure he doesnt get a false reading as per training. as former cop i know i did not want to go thru all the paperwork involved just to get it wrong and have a dismissal in court.
