    He is going under the fair credit reporting act and has the opportunity to list his own rebuttal to the incident.

    DAC will not remove any statement made by any employer UNTIL
    requested by the placing employer or a court order. The employer who placed the statement is the customer, not a complaining driver, Yes,
    they will place a rebuttal on the DAC report after you fight them to do it....DAC is NOT in the TRUTH business-they are in the reporting
    business. They are suppose to be governed by the FAIR CREDIT ACT
    but think it does not pertain to them..DAC could be a more useful service provided the ability to verify the statements placed by a
    trucking company are more easily proven or dis-proven other than the
    current attitude of DAC, which is "we will make it as difficult as possible for you as we can."

    Remember, you must do everything in writing. Dont call on the phone because its wasted in the end. To put your statement, all you have to do is write to DAC and tell them that you want to make a rebuttal. Make sure that you cite the Fair Credit Reporting Act. Ive done it numerous times and people all told me that I couldnt.

    UPDATE.....I emailed HireRight (formerly DAC) and asked them for an info update. They promptly emailed a response back to reflect that they have assigned a case number to the Case and that their team is still investigating but that we will get a response shortly. If any one needs the contact info to contact DAC (now known as HireRight) the number is 1866 521 6995 or email [email protected]

    UPDATE....I received correspondence back from HireRight and they instruct me to dispute directly with the reporting trucking company. However, they do offer me the opportunity to add a rebuttal statement of 100 words or less to my reported information by mailing a statement to them.

    Thats a violation of the Fair Credit Reporting Act. Its Hire Right's job to act on your dispute and contact the company, to which the company will get back to them. Only leave a rebuttal if there is no change in the posting by your former company after responding to your dispute. Read the Act. Cite the Act please.

    I will send another letter off to HireRight again with all the documentation that the Judge awarded me and I will cite the Fair Credit Reporting Act. And as you know it will be 30 days before I have response. Meanwhile I am contacting an Attorney. I have been wronged. The Judge ruled that the Employer had NO evidence to accuse me of the charges that caused my termination. I was waiting to see what would happen with the DAC Report but obviously that is going around in circles and I do not want the time limit statute to run out. I will keep you posted.:biggrin_25523:

    OK, I like you, you have the balls to pursue this, unlike so many others who just talk about doing it and dont, so now Im going to teach you some tricks to rattle their cage. Years ago I was a credit counselor. My first job out of college was working in a credit collection agency and they drilled me on all of these credit laws. So I started helping my friends with their credit problems and then I got a course that showed me how to make money with it. Anyway, here is the trick, under the law, the company that reports your credit must represent your credit overall. Waht this means is that if they report anything bad, then they must report also the positive aspects as well. The idea is that it must truely reflect your credit. Now, for example, lets say that your utility company reported that you were late on your payments. Well, they also have to indicate that you paid on time for the months that you did as well. You can force the company that fired you to list all of the positive things that could be considered a reportable reflection of your true credit. So now, get a hold a DAC/Hire Right statement of what can be put down in reportable format and start seeing what you want put on statement that you feel will truely reflect your overall experience there as a worker.
