    You need to reread schedule 1 (as written for the Reefer Division) - better yet, take it to an attorney and have him explain it to you.

    Paragraph 1 specifically sets out the provisions for the percentage split of linehaul revenue between the company and the contractor. Nowhere in this statement does it say that Prime can take more than 28% of the contracted charges. What you are claiming is that Prime violated this clause... because they would have to in order to average your per-mile rate down to 85-cpm overall - unless you made a habit of pulling total c.r.a.p. loads.

    Paragraph 2 states that Prime will not let the average reconcilled revenue drop below 85-cpm per dispatched mile, and will provide advances to ensure that this minimum is met. Its a FLOOR, a MINIMUM. Nowhere in the agreement is a maximum indicated. And in fact most of the lease-ops I know make considerably in excess of this - albeit this time last year wasn't very good for ANYONE.

    No one was getting "ripped-off." Prime would have had to have violated the contract if they received more revenue than they were entitled to - and you have a right to sue for compensation and damages. If you believe you were, you can inspect all of the freight contracts that you pulled at Prime in Springfield, MO. That's federal law for any carrier that pays a percentage of a freight contract to an independent contractor.

    wow alot of prime helpers on here. good luck to all who want to get abused and lose your shirt when the goin gets tough. in done on this thread why dont you guys go over to the good side and praech about prime and how you can make soooooo much money and never go in the hole.

    I haven't heard alot of drivers lately saying they are going to Prime to LEASE in this economy. As for myself (and many other Prime newbies that have posted on here) I'm going COMPANY. You said it yourself.. "company drivers are ok there."

    Thanks for the advice though.

    Not unusual for one of our team trucks... great if you being paid on a cents-per-mile basis. What most ex-company drivers going lease don't understand is if you're being paid on a percentage-basis, miles don't matter - only the revenue to the truck. In fact the higher the revenue and lower the mileage, the better off you are.

    I was at prime in 96 and after 6weeks they just keept me so broke i had to go so i headed pack to springfield from phoenix and they put out a message in the QC to stop my truck to get a reward but i made it back and got my PU and went home .. found out several weeks later they put a abandonment on my D.A.C so i contacted Sam Cope at prime and he said TOO BAD ... so i got a laywer and he contacted them and was told by their co attorney to "Get in line"... so think before you go work for these deadbeats...

    Get in line? LOL, I still cant understand WHY there truck payments are so high..?? I just compared a few other refer outfits (CR england, Central, etc.) and the leases are alot cheaper somewhere else.

    BEFORE YOU START WORRING ABOUT PAYMENTS READ FURTHER!!

    the truck payments are much higher than going through a bank is becuase you'll own the truck that much faster and when you go to turn it in at the dealer it has more value.

    ans second you make between $0.85 to $1.00 depending on the company( i know at JOHN christner its 93 or 96 plus incintive).
    SO DO THE MATH if you run 3000 miles that leaves you nothing after for you after fuel and the payment. and if you only running 3000 thousand miles a/wk something is wrong and that pretty much leaves nothing for you. now refigure that with 4000 or even 5000 miles a/wk. and say # $1.00 a mile and some where close to $2000 in fuel and a $800.

    and let you do the math on that. and my friend twoo weeks ago turned in 6800 miles for the week and never drivers over 64 mph!

    AND I DARE SOMEONE TO CALL ME OUT ON THIS!!!

    that exactly what i thought he says he did it for five weeks and still owed them money

    i only know one company that a guy have actually turned in 6800 miles for the week

    and believe me he didnt owe any body money
