Sales Tax Exemption

    California charges their sales tax to any purchase, even out of state, unless it is physically delivered across the state line. So, you couldn't come to our lot and drive your own truck away without paying, then applying for a refund. Screwed up right? We get around that altogether by using our Nevada location for any out of state deals. It keeps the paperwork clean and easy, plus Vegas is a more exciting destination for a customer to receive a new truck compared to the suburbs of LA.

    Do you know if this applies to lease payments on the trucks as well or only if you purchase them? I'm leasing heavy trucks from Donlen and have a PUC and MC number and feel the trucks should be PA Sales tax exempt, but want to make sure before I give them my form. Thoughts?

    I believe it does, although I am not sure on long term leases. I am sure Donlen Financial will know if it is applicable. Reading the PA Dept. Of Revenue Form 1220 it appears to apply to rental and lease fees for motor vehicles.

    So this covers Georgia ad vorlem tax when you’re trying to transfer a truck title?

    No, this is for sales tax only not ad valorem, the only way to avoid ad valorem is if the truck will be registered under IRP, if so you need to fill out Form T-146 (see link) and take it with you to the county tag office when you transfer the title.

    If your not going IRP, you will have to pay the ad valorem tax to get the title. The only good thing about the ST5 is if your buying parts,etc. they dont charge you sales tax (also good for out of state).

    I see this answer is from 2015. did anythng change? choosing option 6 in ST 5 didnt look right from description. any help is appriciated

    The form has been revised since then. Using the current one on the DOR website (rev 07/2021), choose option 7 and put your MC number in the blank space immediately below it.

    Anyone have any issues with purchasing in Florida using the Georgia exemption? Bought a trailer and I'm being told that I need to hire a 3rd party common carrier to transport it to my location in Georgia and that I can't pick it up or I will have to pay the sales tax even thou I'm a common carrier using the exemption I have from Georgia. Haven't had any issues purchasing trucks, trailers or parts thru out the US using the exemption but this one auction/dealer is claiming the above but can't reference any Florida statue or code stating what they are saying.

    Call the Florida internal revenue people and ask them. I don't remember if the tax has to be paid and a refund is given or if it is just clear removal with no use or sales tax applied.

    Let's play their game, I would hire any O/O to just move the trailer off the auction property, drop it somewhere just outside the fence, and take it from there. Nothing illegal with that, you are engaging a third party to remove it out of the hands of the auction house, transferring responsibility to the O/O and he is handing it off to you because you are an interstate carrier, this all fulfills the demands of the auction house.
