Equipment Damage Payroll Deductions Company drivers

    I can verify that . On my last week with one company they erred and overpaid me . They corrected it by deducting the entire amount and redepositing the correct amount . But the new deposit wasn't made until a couple of days until after the deduction . I wasn't notified and had a couple of bounced checks . One was a $200 deposit for a new apartment . The landlord refused to rent me the apartment because of the bounced check then resubmitted the check when it was good the next day and kept the money claiming they lost money having the apartment empty longer . They never called me when the check bounced .

    I want to thank everyone for all the helpful info. I have sent correspondence to the Ohio state attorney general addressing the issues raised in previous threads and will update when I get a response. To answer another question, I was a company driver. I didnt damage equipment all the time (a ding here a ding there on a trailer) jsut so you know. The reason I left the company is becuase I rolled a semi. I was not cited for the accident. The load (palleted ink drums) was loaded the exact way it was loaded for the driver who "trained" me on the very first run I went on with him for the company. I was not speeding and it happened on an S curve entrance ramp. The company did not immediately file a BWC claim. I had to file my own four days later. They were also telling me I would have to pay 5000 out of pocket over time for damages. I quite the next week. They would not pay me for two box truck runs I made once I was given 100% return to active duty. I busted my hump for these guys. They have insurance for a reason and I dont feel the accident should be a justification for all the things they were doing to screw their drivers. Once again thatnks for all the imput.

    You should really go back and read your CDL manual. The speed limit in a curve, is not always the "safe" speed in a curve for your truck. Also, you are responsible for ensuring that the cargo in your vehicle is properly loaded, not your former trainer. If you weren't cited, I would think you should have been. It's called too fast for conditions.

    The trucking industry classifies accident into basically 2 categories: preventable and non preventable. This is obviously a preventable accident, because if you were driving a little slower you wouldn't have rolled.


    Another thing you might want to consider Leo, is that if you had stayed at that company and allowed them to payroll deduct small amounts until it was paid off, they may not have reported it to DAC.

    You left the company with a wrecked truck and a huge cargo loss claim. There only recourse is to Villify you through DAC.

    There is too little information here to establish cause . Without an investigation report we don't know if a suspension component may have failed or the load may have appeared to have been properly secured and a strap may have broken during transit . There are many possible causes .

    ok so my company had me listed as a contractor so i payed 2k for a truck deposit now that i left shes charging me for a shifted load bill for almost all of the 2k deposit can she do that the deposit was for damge to the truck and was a post to comeback to me if the truck was undamaged

    Did you have a contract with her?

    If you didn’t, call your state labor department and the irs and file a complaint. You as a driver without a contract is an employee, they owe taxes and can’t hold any money from you.

    What i am asking is can she hold my depoit from me as payment for a load that got damage. when the deposit was for the truck

    @Ridgeline gave you a good answer. Do you have a contract with her? This makes all the difference. If you have a contract then whatever the contract says is what she can do. If you don't have a contract then you are not an independent contractor, 1099, but an employees. Contact your state labor board to get your money back. Also, file a complaint with the IRS.
