    yes that is true but it was routine for all the trucks to be in every weekend ...the move was not a consideration of the driver by the company in this instance....just routine....not trying to argue either...:biggrin_25525:

    I agree and what's even more arrogant in my opinion is that the CEO acts like if(and that's a big IF) they get things worked out with their creditors, that he honestly believes people will come back to work for them, especially the drivers.

    I'm just going by my personal feelings on the matter. I would be pissed if I was fired with no notice. But I'd be livid and absolutely on the war path if I got stranded away from home.

    you are right...not much has really been said since this is a very small community and everybody is related but it was rotten just the same.....

    This stinks to high heaven. I'm not privy to inside info, but this is just downright suspicious. I know creditors can demand payment and seize assets etc, but that's normally a last resort. This guy acts like at the very last minute the creditors demanded payment and it's all their fault. Sorry I don't believe them. According the reports paychecks bounced last pay period and no mention on fixing that. This just sounds like a very poorly managed company who chose to ignore all the warning signs and let the company and the employees go down the drain. I know companies have closed their doors before but to strand the drivers away from their homes and shut off fuel cards so no one can buy fuel is a new one on me. Don't think we have heard the last of this fiasco. I feel for the employees and their families. Just another black mark against the trucking industry as a whole but this one directed at the company. Read some of the comments in the Tulsa World coverage and you get the idea the people who owned this company considered themselves something special. Not true of the man who started the company. Nothing but good things to say about him. It's such a shame when something like this happens, but it is nice to see the positive responses that have been posted in the Tulsa World from trucking companies and other people offering to help. My prayers are with the employees and drivers of Arrow Trucking.

    I am still waiting on "instructions" on what to do with my International. I think it s a joke. Why should I go out of my way to turn in my truck after not receiving a paycheck? What can I do in this situation? Hold the truck hostage? Sure, it sounds good on paper, but I don't really know if that is legal. I could keep all the equipment, but, again, dont think I can legally do that. If anyone has any SERIOUS suggetions, or maybe a couple funny ones, let me know.

    You should be able to get some quick lawyer advice. But I would sure think that you could hold their equipment hostage until they paid.

    Be sure to unhook the QC so they can't find it where you are hiding it.

    Hey MM can you know a lawyer. Can you get any probono advice from him?

    HH, I'm so sorry that you are in this position. I wish I had some sound advice for you. Just don't do anything that could cost you your freedom. If the truck is financed, then you will have to eventually answer for keeping it to the finance company, so I don't think that its a good idea. But I would certainly get some advice from an attorney, before you get yourself in trouble.

    I'm not a lawyer, but if it were me...

    I'd contact the Department of Labor in my home state and ask them what my options are.

    I don't know if your home state, or Oklahoma (Arrow's corporate HQ), would have jurisdiction in this instance.

    But, the first thing I'd want to find out is who has jurisdiction, then I'd want to find out what my options were under the law.

    What I'd want to try to find out, is if it was possible for me to file some sort of a "lien" against the vehicle in my possession. In other words, your employer owes you back wages, and you have certain "tools of the trade" that are the property of the employer in your possession. Is it legal for you to hold this property as collateral until you are paid the back due wages owed?

    If/when you call them, be sure to make it crystal-clear that you didn't take the vehicle, that it was assigned to you in order for you to perform the duties of your job.

    Something else that I've been wondering --

    Is it that Arrow hasn't paid anyone in a week or so - paychecks should have been issued and weren't? Or, did Arrow actually issue paychecks, and when they were presented for payment they were returned for insufficient funds?

    That might be something to look into - there's a huge legal difference between owing someone money and not paying them, and actually issuing them a check as payment and having it returned by the bank.
