Watch the video. Unlawful arrest is grounds to sue the #### out of a police department. So if you know the law, stick with it. If they arrest you because you are right and they are wrong, you'll own the department.

You can't stop a DOT guy for writing you a violation for a non existent law. But you can fight it in court where you have a right to present your side.

There is an entire youtube channel devoted to cops basically being wrong or handling a situation wrong. Here is just one video. Subscribe to the channel and learn a whole lot.

Most 5S lawyers end up confrontational. Thus the bracelets.

There is a reason that the speed limit sign doesn't say "Don't drive too fast." Because that's too arbitrary. What's too fast? Your idea of too fast and mine might be totally different. So they put a number up there. An actual number that is enforceable for everyone. It's called a speed limit. Go above it, you're breaking the law. Simple.

One thing that doesn’t help either is companies using scare tactics and spreading misinformation to their drivers in order to get them to do what they want them to do. That usually results in a driver not taking the time to read the actual regulations and taking company policy as gospel and repeating company policy to everyone as an enforceable regulation.

It's not a scare tactic. It's a company policy. If the driver doesn't agree with it. He has the ability to go to another job.

Yes it is a scare tactic. If they threaten to fire a driver for not doing something that they say is a DOT rule when it's just a company policy, that is a scare tactic.

Companies put the fear of God in their drivers about doing a pre-trip when, by law, it is not required.

It's a scare tactic because the company is lying, claiming it's a dot regulation when it's simply company policy. An example that's clearly company policy is even though we qualify to use the time card exemption, they still require us to use an elog.

Sad thing is, we have a poster here who's convinced company policy can be enforced by DOT..... Talk about brain washing.

And for those saying to use common sense.....
Sure it would be nice to, but the law doesn't work that way,

Your argument s are pointless. Inspection s are required. If they were not . Carriers would not spend the time and money enforcing it , only an idiot drives a truck without doing an inspection A few years ago a driver had stopped in New Mexico. When he left he did not get and look around the truck . A man lying in front of the truck was killed. A DOT Officer wanted to prosecute him for being negligent.
