    Back before I had a CDL....(in my younger and dumber days....)
    I got pulled over after having partied all night.....
    Had an oz of weed and an "8 ball" of blow.....In my jacket......Troopers never did a search...... (whew!!!!!)


    Had to do a sobriety test and passed it both times...
    That was the last time I did that......

    I guess after doing something like that...I should have run for office......:biggrin_25523:

    Those are all good points. I'm just someone who is a stickler for facts. There is absolutely nothing wrong with just sticking with the .04. It's much safer that way anyway. Better yet, don't drink and drive, period. Unless you carry around your own analyzer, you don't know what you'd really blow anyway.

    I'd also like to add that the reason I corrected people who were wrong is because it's smart to know the law. If someone is told they will lose their license for the wrong reasons they can fight it.

    You will be put OOS for 24 hours if ANY alcohol is discovered in your system while driving a CMV, but you will not get a DUI unless you are .04 or greater.

    However it should be said that an OOS for alcohol is just as bad if not worse then a DUI. It will go on your DAC.

    In Cali "wet wreckless" is an alcohol related offense, not a DUI. It can be used in future cases to show alcohol pattern.

    Hence my reference to the "Pull Notice".....

    Anyone who has taken the 60/60 drug and alcohol program required by DOT, would recognize a pattern on a "Pull Notice".....

    How many accidents no matter how minor????
    Property damage...
    Speeding tickets...
    Other violations....

    If you look at "Pull Notices"...you'll see a pattern...
    Does alcohol and drugs play a part....possibly.....

    Cali also has a zero tolerance after the first DUI. Anything over .01 is a DUI after your first one, no matter what kind of license you have.

    I just realized something. One of my personal vehicles is registered as a commercial vehicle. I suppose I could get a DUI with .04 in that one on a technicality. I'll never find that out though.

    Sorry buy you'll have to show me your law where it says when driving any vehicle. I just checked your state laws and all the have for CMV is while you operate a CMV the limit is .04. Please show me your proof.

    I'm sorry if that's the way you see it. My position is show the reference before someone pops off without reading all the information out there. To quote a law without checking is just as bad as driving while drinking.
