CSA 2010: How will the Driver Rating System affect you?

sum1 correct me if I am wrong! But if I understand what I read correctly, a DRIVER CAN have a "NOTICE OF CLAIM" filed against him that is just a fancy way of saying that the DRIVER is being fined for a previous violation??? In the same way that a company is "noticed" of an offense?
Did I read that right???
So even if I didnt get a ticket or fine at the scalehouse or roadside inspection that I can still expect a fine sometime later??? Or does that mean if I get a ticket/fine that I can expect ANOTHER FINE later???
How long can they wait before it's too old to screw you twice for the same offense?
Has this always been they way it's been done or is it new?
Mike MD would be probably the best person to answer this. Or I would trust another LEO's answer over a truckdriver's.

ENFORCEMENT MORATORIUM FOR 2010 REGISTRATION YEAR
Summary

This message announces a moratorium on enforcement of the UCR effective January 1, 2010 for the 2010 registration year. This moratorium shall remain in effect until further notice.
Please be advised that this moratorium does not impact UCR requirements as they relate to previous years.

Background

An amendment to SAFETEA-LU has changed the methodology for determining fleet size by including only power units and eliminating trailers for the 2010 UCR registration year. This significant change to the statute requires modifications to the fee structure that must first be promulgated in federal regulation in order for the program to proceed.
When the rulemaking is completed participating states will mail registration notices to all entities subject to the UCR allowing for a reasonable time period for companies to remit their fees.
When participating states have agreed on a 2010 enforcement date an updated enforcement bulletin will be issued.

Enforcement of a Previous UCR Registration Year (2007 - 2009) after January 1, 2010

In order for roadside enforcement of a previous UCR registration year to take place after January 1, 2010, enforcement staff should first obtain evidence of interstate operations occurring during that particular registration year. Proof may include but not be limited to log entries; toll receipts; shipping papers; bills of lading; previous years apportioned receipt or prior years roadside inspection reports.

Maybe I'm a little hung over, but is promulgated even a real word? For some reason I can't seem to read this without going, "What??!"

 

Promulgated is a real word...It means announced, Issued or declared depending on the context.

 

In a nutshell-These companies are not going to change their repair policies or the way they do business.In the first place they are barely staying afloatand spending more money is against the bean counters religion.The only way for this industry is going to survive is to go back to regulating the rates and get rid of the companies who think they can haul for nothing.I dont like the idea of giving the feds more power over us but the only other thing that would help is for everyone to shut down including the union companies.They are in as bad of shape as the rest of us.Anyway have a happy new year.It has got to be better than 2009

 

Dave, I'm not one of the legal gurus, but I'm assuming it will be 2 years since they (DOT) will be going back to 2008. By the way, 2010 is broken down a little more on the OOIDA's web site.

Krash, unfortunately 2010 will have nothing to do with how much the freight companies will haul freight for or shipping rates. I wish it did. Also for the campanies that refuse to chang their repair policies, they will be out. Under 2010, the companies will only be allowed so many Violations and thats any violations not just OOS violations. I do think that the new 2010 regs will eventually be better for everyone but it will take a while

 

Did you check the DVIR from the previous driver ? That's part of the pretrip . If there is no DVIR you write one yourself .

The 396.13 is the key . You have to review the DVIR and accept it . You shouldn't accept it if there are uncorrected defects . You do NOT drive somewhere to report it . Don't move it or you are in violation with no excuses .

 

There's so much talk about CSA 2010 and the prediction that 175,000+/- drivers will lose their privilege to drive commercial vehicles. What percentage of drivers, in your opinion, shouldn't be on the roads at all.
Forget CSA 2010 for a moment. Just focus on what you've observed, day in and day out, on the highways of North America.
