I realize that this conversation is almost a year old but thought I would provide relevant context.
Being that it's in a commercial vehicle conducting interstate commerce and the possibility that the vehicle is in one state with office personnel in another state, federal rather than state law would apply. If a driver works for a company that has office personnel located in multiple states, it's not reasonable to think that the driver would be expected to know the laws for each state, especially when the driver may not be privy to the location of the person on the phone. As a person who is conducting business that falls directly under federal statute, it is reasonable to expect the driver to have knowledge of federal law covering things like communication with another party.
