    But who would get the charge? Did the guy prepossessing endanger the child? Or was it the mother for leaving her child in a running car that she obviously wasn't pay much attention to?

    When a vehicle is repossessed they sometimes have the key already. It would not matter if it was running or locked.

    I am sure there are many here that did not take their child with them to run into a building for 15 seconds.

    Hardly endangerment.

    I just asked. I have two girls and they never sat in a car unattended but the car WAS running. And they always have the key. All you need is a VIN and an Order of Repossession and the dealer cuts you a key.

    I don't see how someone driving the car to get it back is endangerment either. I mean, he obviously had a vested interest in not damaging the car so I doubt he was jumping railroad tracks with it.

    The article said the mother was waiting outside the car. To me that infers she was standing beside the car. That's quite different than leaving a child unattended and going inside a building.


    I personally think the repo guy should be charged but then it's simply my opinion and doesn't seem to be the law in San Jose, CA. *shrugs*

    Just a thought though: where did it say the mother wasn't paying attention? The way the article is written it sounds very similar to a carjacking.

    Obviously we read the article differently

    When I read it I didn't see anything that gave the impression of force or coercion to get the car. She could be waiting by the car but not looking at it or being aware of what the child was doing. If she were paying good attention she would have seen the man and attempted to stop him but the article made no mention of that. they surely would have mentioned a mother screaming for the man to stop or even physically trying to stop him.

    I don't know you but I bet I know this. If you were that woman this would have gone down differently.

    Maybe she should have kept up with her car payment........................She is at fault for it, in my opinion. I know that if I don't make my car payments the bank is going to send some one for the car.
