Setting up a new Authority: waiting on IFTA account

IRP stands for international registration plan. So when you get your own apportion plates, you have an IRP account. This time of year during renewals things take the longest.

 

A little history.....

During the 90's the FMCSA decided to give 'registrant only' DOT census numbers to individual owner operators with no real idea how many independents really existed AND how many were operating on the Lessee's census and MC numbers.

Being from the government, they decided to 'fix' this problem by making individuals show who's authority was responsibile for them with a copy of the lease and actually started to enter the 'Motor carrrier responsible for safety:' placing the name and address of the responsible carrier on the registration.

NJ needs our DOT and EIN numbers to complete an operator's registration.

FCMSA still does not know it all.

Once an individual changes carriers; the info is incorrect until the next registration renewal.

When John Smith, an independent leased to a Motor carrier decides to obtain his own corporate identity and authority; once it is active can re-title his tractor in the corporate name, can re-register the power unit [usually at renewal] in the new name and show his own DOT and EIN making his corporation responsible for safe operation.

Most of my port guys have their own corporate ID and those with DOT numbers do not have our info on their registrations making their roadisde inspection history and often very confusing if they give their insurance info after a collision instead of the actual motor carriers.

 

You are going to need a TXDMV number or like some call it a TXDOT number to run intrastate loads in Texas.

 

I haven’t read all the threads. But I think you’re asking if you can keep running under another Carriers MC, DOT, and IFTA while setting up your Own Authority and accounts. Answer is yes. The next question I think your asking is, Can you transfer your Plate from their Authority to Yours. Answer is yes. As long as its in your name. If it’s in their name, it’s they’re plate. Assuming it’s in your name, once the Lease has been terminated With current Company, the plates no longer attached to them. As far as that goes, once you transfer the plate, your current Lease agreement is probably no good, anyways. No real need to cancel the current Lease agreement. Might want to read the current Lease real good. Make sure you get all the money they Owe you. Sometimes Companies play games whet its time to part ways. You’ll need to send them a Drivers history verification employment request. By Law they have to return it to you, for your Drivers Hiring records, on yourself. Once they get that request, they’ll know you’re leaving. Get your money first, if you have any doubts about their honesty, or dealings. The current Lease agreement wording is what’s Legal. Still don’t need the hassle of fighting for your money. Timing is everything.

 

Timely post. My brother and I are going to have to tap the brakes on our plans now after seeing this. Didn't realize the entire process took this long.

 

Theirs also a 3 week waiting (protest) period rule, leftover from the days of Regulation. I’m not sure exactly, but seems I had to buy insurance first, then wait 3 weeks for Authority to be active, and be able to run. It may have changed by now. My Insurance company may have mislead Me at the time. Regardless, it’s something to consider. Paying for insurance and being ready to go as soon as possible to help cover the cost. IRP and IFTA Account’s are free. Only cost will be for Plate renewal when it’s time. The insurance companies always keep 30 days in the hole. That covers you if you’re ever late on a monthly payment. They have to give you 30 days notice, before cancelling your insurance filing with FMCSA. Avoids problems.

 

I'm not sure what a CTP/A is, could you explain? Is it in regards to controlled substance training or a designated employee representative?

 

It's C/TPA, and it is a consortium/ third party administrator.
You have to have one to handle all the crap with the Clearinghouse even if you are a sole proprietor.

 

If you're a single O/O, do you get to manage your own drug testing? Of course not, because it would be super easy to cheat. So if you're by yourself, you have to have a third party handle your randoms for you. Let's say a couple years from now you hire a few drivers. Now you can manage their drug testing. But if you also stay in the truck, you will still need a third party to administer yours. Basically, you aren't allowed to be in charge of your own randoms.
