You got it...like was noted in another thread...no jury, no chance to argue your case, just at the "whim" of some LEO.
And BTW, I have noticed reading these posts on all the threads about this CSA 2010, the fact that there are actually more student/newbees/wannabes asking questions about this than there are "experienced" drivers..to me this is a good thing..a group being made aware of the "changes" to our lifestyle, not just our jobs, but this will effect our overall lifestyle in these big rigs.

The gov doesn't realize that LEO's and DOT are folks just like everyone else, they have good days and they have bad days.
That's why they have Instant Replay in the NFL...and that's just a game. Trucking isn't a game.
I agree wholeheartedly that the bad drivers need to go. But by their own example given, the infractions are subjective. There must be some way to contest the points and expunge your record.
Even the students in our class have the ability to "expunge felonies" and other "crimes."JustSonny Thanks this. -
As a driver, you can send in a rebuttal/explanation statement that will (supposedly) be put in the record...however, the points and infractions noted remain for 36 months...even if you change companies...it is a DRIVERS SUMMARY REPORT

Hmmm... So let me ask... We ran into some hoopla at a SD weight station... Ended up with a $165.00 ticket for being over on our steers, we slid the fith wheel, and discovered it was actually due to our rear suspension not being infalted, got it situated and when all was said and one we left with the $165.00 ticket and a warning for his log book not being up dated.
So, does he get points for either or both of those?
And, what about me as the co-driver... I would of noticed the suspension during my pre trip, however,he doesn't do any pre trip and Since I drove all night, we parked and he slept a cople hours then took off... no pre trip and I was asleep the whole time until I woke up at the WS.
Who gets what points?
My log was good... he got a warning for his not being good
What about the being over on our steers and the ticket... does it go on his record because he was driving at he time... or on both because we are a team... actually though, he is my trainer... so we are not 100% team. -
My guess would be the points are the responsibility of the driver in control of the truck when the violations were discovered.
as to which offense earns points, each offense should be listed on the citation/inspection report. Each violation should also list which section of the regulations that were violated. Using that inspection report, you should be able to figure out how many points were "earned".otherhalftw Thanks this. -
Let's overlook the fact that Joe was speeding, with a log book incomplete, on a low tire.
So "Joe" is far from innocent.Maybe next time Joe will obey the speed limit,keep his duty status up to date, and check his tires at his lunch break.
But no,let's just keep making excuses and blaming "the man"

Where did those point tables come from?
It was my understanding that the tables were still in "flux"(whatever the hell that means) according to the FMCSA rep we had at our meeting last Saturday.She said that the "pilot" states didn't even match up yet,so the final values rtemained to be determined.Or maybe it was the weighting she was referring to. -
From what I've read, the "weighting" of points is etched in stone. It's the threshold values that have yet to be decided. Another thing that is a little confusing is, e.g., a "6" in one BASIC doesn't necessarily make it equivalent to a "6" in another BASIC.

My understanding is that the points for each violation have been set and published on the websight. The number of points needed to be declared unfit to drive have not yet been published (established) by FMCSA. That is still under consideration. I have seen companies putting numbers out through there safety departments but nothing from FMCSA.
