Omnitrack question

    Just a quick question I hope some of you can help in, Company I work for says it is illegal, but my previous one said it was. I talked to DOT inspector on phone about this situation and gave him exact times and on and off times he he said I was legal . So here goes,
    On Wednesday I drove split shift got my 8-2 in and drove til 9:30 pm that night, took a 3 hr sleeper berth, which put me at 12:30 am. Drove for exactly 4 hrs 46 minutes and stopped at delivery place, went to sleeper berth for 4 hrs til delivery time. ( this is where I drive in slow enough to not wake up eld into driving time) to dock to unload. So the company loaded my trailer wrong. Had 2 deliveries on it put the last one first, and there was too much product for delivery one to move out of the way to get to their product, so had to get to delivery 2 which is 5 miles away to unload first. Called dispatch and told them about snafu and said I still have 3 hrs and 13 minutes of drive time and can get to 2 delivery, unload and back to delivery one and unload, then get to my reload 1 hr away, before I restart my 7 hrs mandatory sleeper berth. Their response is I’m out of driving time. I told them no I still have 3 hrs and and 13 minutes I can drive.
    All my previous days have been split shifts and met with the requirements of combining into 10 hrs of sleeper, and not close to 11 hrs drive time , with 30 minutes break on days when doing 8 hrs drive, just to be safe. Is the company I work for wrong or am I right and ok,

    If im not mistaken you can only do 1 split break then u gotta do a full break then u could do a split again.

    The ELD will show a violation, which will go away when the requirements of split break have been met.

    I do it often.

    That is what I tried to tell dispatch, (female) but was having none of it. Not that I have any qualms about female dispatch workers, but this one seems to have a authority complex. Thank you. Had 2 dot inspections on previous company route, reefer, and always drove splits no tickets for eld violations

    The thing is, technically, it is driving in violation until the split break rule is completed.

    Back in the days before ELD, some said you had to take the long break in the sleeper first. Even a fed stated that, but I stood my ground that it wasn't correct. I didn't get fired, either, and I am cited by the boss as knowing how it works now.

    Regulations do NOT require you to take a 10 hour break after taking a split-break. You can split-break one right after another indefinitely. Company policy may limit split-break.
