Paying Truckers A Fixed Salary

    Well any time you have a contract I guess you need an attorney I am getting him to send me the provision of law... Has something to do with labor laws but if I am a driver I figure I fall under federal as we hold a CDL...

    You wouldn't catch me working salary as an OTR driver. Not unless it's about $60k a year. Other wise they just talked you into cheap labor and will work your ### to bone and push you for everything they can take you for. Something doesn't sound right here.

    Well 55K with all meals and expenses incurred over the road paid in addition to... I would be home most weekends go out loaded come home empty... I think its a more than fair compensation package his lawyer just needs to work out the logistics of it all...

    I drove for an outfit once that "Paid Salary".....

    It was a fixed amount every week.

    40 hrs reg......24 hrs OT Good $$$$$$$$$

    Worked out alright for 6 years.......the company changed things to benefit 90% of the drivers.

    I was in the "Other" 10% and took a pay cut along with the new pay scale. Work load went up and the pay went down.

    I found someplace else to work.

    There are many ways a driver can be paid:
    Hourly, .cpm, percentage of the load, or even salary.
    Whatever pay scheme is employed, as an employee you must receive at least the federal minimum wage for all hours worked.
    However, truckers are exempt from the overtime provision of the FLSA.
    So don't count on time-and-a-half after 8/40 hours.

    All of this goes out the window if you do the 1099 thing.
    Why anyone would work as an employee and be paid like a contractor is way beyond me.
    Of course, this is trucking we're talking about...

    Sounds like a good deal.

    Me personally, I don't like being on salary. Did that for 7 years, though not as a driver. No matter how hard I worked, I always got the same paycheck. Again, it's just my personal preference.

    Well my best friend worked for an outfit for 11 years and was paid salary. He loved it, until the old man that started the business got ill and his kids took over. He made $65k a yr for 11 yrs. Some weeks he was gone 3 days some 5, home every weekend and great benefits. They had almost ZERO driver turn over and had some very top notch drivers in their fleet. After the kids took over the business they turned it into just another sh*thole company so he left as did 90 percent of the drivers that worked there. It is not illegal to be paid a salary but at the same time I wouldn't do it for $30k a yr either.
