You misinterpreted what I'm saying. I don't think I'm being clear here. All I am trying to say is age is a bona fide occupational qualification when it comes to commercial driving. Ask an attorney and they'll explain it a lot better and tell you I am actually correct that maximum ages are rare, but they're not illegal because commercial driving is exempted from the ADEA. I am not saying maximum ages are required, they aren't and most employers aren't hesitant to hire more older drivers, but in my region, we do have a maximum age for bus drivers here.

That's about requiring a physical. It has nothing to do with age.

P.S. I asked for laws or court cases, not opinion pieces.

Incorrect. The entire case was predicated upon Tamiami's policy of rejecting applications for those simply based upon their age being over 40.

I misread the law, turns out you're actually correct. Sorry about that, it was a misunderstanding.

I was wrong, sorry. The law is very complicated so I left it with a relative of mine who is an attorney and you were correct.

I am over 77 and still able to move to another carrier. Those carriers that will not hire seniors end up with rookies. Good luck!!

Maybe you old geezers should hang up the keys and start yelling at kids on your lawn instead of rookies who probably don't have a radio anyways.

That's an idea. I'll let you know when it's happening and you can come to one of our drivers meetings and explain that to the geezers that work for us. There will be about twenty-five of them. Good hands but not real young.
Only thing is, the youngest guy at that meeting is pushing fifty now and the oldest is in his eighties. Don't let that slow you down though, just jump right in there and run your mouth about older drivers needing to hang up their keys. I know for a fact the younger guy and two of the guys in their sixties like to brawl 'cause I've bailed them out of the tribal jail for doing just that
We don't allow fighting when we're working but driver's meetings are held downtown. After they're over it would be my guess that maybe some of the guys who took exception to your little speech might want to discuss it further with you.
Is your dental insurance up to date? ;)

Banker, InTooDeep and RunningAces Thank this.
