Got a couple of questions. You are keeping paper log today because the ELD is malfunctioning, then you switch trucks to one which has an ELD working fine. You used paper log from 6am to noon, at noon you are on ELD. What do you do with a log sheet with a half day completed on it? How do you handle the certifications when the ELD asks for a certification for the last 7 days. Hope I have explained the situation well enough.

Easiest way is simply go in and edit the times in the ELD if it's only been half a day, then certify the next day. Toss the paper log.

You can keep and use both. You will, of course, need to follow HOS rules and ignore available time on the ELD for today. If you get pulled over though, well it's easier to just hand the officer and ELD and don't even mention the malfunction unless he asks.

Lets say it involves several days of using paper logs, then say on the 4th day you in a truck that the ELD is fine??? Are you saying that I need to go back 3 or 4 days and edit the ELD so I can certify each day.

Well, since you only asked about today, I only answered about today.

But to answer for the last several days, I mean you can but there really is no need to. It's really all about the "If I get inspected, what's the easiest way to explain to the officer." Is it easier to just edit the ELD, or show the paper logs. Keep in mind form and manor violations are almost nonexistent on ELD's. But it really boils down to what you feel more comfortable with.

ZVAR makes good points, but I've had it happen, and what I did was continue using the paper logs until I had a reset sometime after the week of use of the ELD, and let it catch up to me. Then use the ELD only but preserve those logs. If your company has a policy to cover this transition follow it, if they don't, I'd ignore the ELD until the log book and the ELD get in sync. I once had a malfunction that had me on duy for a continuous period of days...because it was hosed somehow and didn't auto shut down. Went to paper logs until they were able to repair it.
I feel bad somewhat for newer people who haven't had to do paper logs like us, and is thrust into having to use them because of the form and manner violation possibilities, and just for the sheer inability to have had the extensive experience of using them daily without making mistakes. :)

We have or had the problem of 2 ELDs, as the first one was given up on.

Problem is, it still worked for the few using it, so I got stuck trying to use it when my ride was down for fixing. And the lease company didn't provide ELDs, either, so there was that. Either trying to use one with a spotty performance record, or none at all to use. I keep a paper record, unsigned, unless needed, in addition to the machine.

Form and manner can still exist, if you don't fill in all needed blanks, as well. And with the current one, you have to certify before you do anything, and later edit and recertify to correct mistakes, and spotty cell service, due to myriad reasons, ensures that happening much more than it should.

    CAXPT and ZVar Thank this.

I have always went that "route". LOL The incident that I was asking about, went something like this. I made a trip on paper logs, then the next night I stepped into a truck that the ELD was functioning properly, So, on my paper log for that day, I completed the paper log up to the minute I logged into the ELD and on the paper log, I made a notation that I went on ELD at that minute.
