Advice please

    So my co-driver had an accident (head on, as far asI've been able to gather) while I was in the sleeper last week. I was ejected from the truck and flown by helicopter to the trauma center in Palm Springs. About the only memory I have was me yelling at him "what the #### happened?" To which he replied something like, "sorry, I must've fallen asleep." Once I got a hold of my company, they're are saying that there was another on the road and traffic came to a stop too quickly for my co-driver to stop, so he turned left and our trailer didn't clear the trailer ahead of us. Not an issue of him falling asleep. I don't believe that story. So, I guess I'm asking for any advice on how to proceed. The accident report hasn't been available yet.

    You’re only worry is a seat belt ticket for not having the bunk restraints up. I don’t think there’s a penalty for waking up in the middle of someone else’s accident scene beyond that one.

    lawyer up. plenty of accident lawyers that may very well take your case. seat belted in or not, he was responsible for the accident, and your injuries.

    check with lawyers in the area where the accident happened.

    have you lawyer try and get you workmans' comp as well.

    do as much as you can to nail your co-driver. your life was in HIS hands.....he is responsible.

    obviously, he did not admit to falling asleep to the company....

    he cannot lie under oath..nail the SOB...
