I feel like maybe I haven't explained the situation well, so I want to add some details. The engine that is in our truck isn't the engine that is supposed to be in it; worse, as far as we can tell, the engine in our truck cannot LEGALLY be in it, as it is a 1993 pre-EGR, and the engine that was supposed to be in our truck at the time of sale was a 2003 EGR per the re-man number associated with our VIN. It seems pretty clear that at some point, prior to our purchasing this truck, the engine was swapped. Am I correct in believing we can't use the engine in our truck? Am I wrong in believing this is fraud? And if it is fraud, what are my next steps? We are trying to get the build sheets now.

Not sure how this could be fraud. Dollars to doughnuts the original engine went BOOM! at some point and the owner at the time just swapped in the one that's in there now. Quite common to swing a new/reman/used running engine if the original block does not meet suitability criteria for a rebuild.

Engines (I believe) were required to meet the new emission standards in the later half of the 2002 ENGINE model year (not chassis model year). It is quite possible that a pre-emission engine was factory installed in an early 2003 chassis.

My understanding is there were, for the most part, no 2003 and 2004 engines. Again, I said for the most part, so don't attack me for the oddball engines. All the manufacturers and consumers were concerned about the upcoming EGR engines, so they made nearly 3 years worth of 2002 engines. The reman shouldn't be proof, but if you're talking about a PACCAR truck, I'd be willing to bet a lot of money that it did not have a 2003 engine in it.

Ok, I reread your other post. It is a glider and it had a 2003 EGR engine originally installed, or it was a 2003 reman?

And truthfully, I doubt in a glider you will run foul of the epa unless the glider was assembled after the new epa regs.

What's the vin number? If it's a glider it's easy to tell by the VIN. Otherwise swapping an epa engine or a non epa engine is illegal. Make the dealer make it right or sue to either buy the truck back or put the correct engine in.

It is supposed to be a 2002 re-man in our truck; but the engine actually in our truck is not the engine associated with our VIN. The re-man plate is for a block that has been converted to DDEC 4; our block is absolutely not converted, nor is it ready for conversion.

We have a 2018 Freightliner chassis, the block currently in it is a 1993 detroit series 60 DDEC 2. Can we legally patch this engine, and keep running paper log and non-DEF?

I am not sure how to answer, except to explain that our chassis went from Freightliner to Fitzgerald to be fitted as a glider. The re-man number on the plate on our block is the re-man number Fitzgerald assigned to our VIN, for a 2002 series 60 DDEC 4, a Glider. The engine this plate is attached to, however, is NOT a 2002 DDEC 4. Going by the number stamped directly into the block, it is a 1993 DDEC 2, it is not converted, and it has never been associated with our VIN. So, according to our VIN, yes, the truck is a glider. But the engine in it? No clue.

Fix your engine and get back to work..
Because it has a newer engine vin according to the truck vin maybe that's a gray area to put and older motor in it, but a 2002 model with egr isn't really an emissions motor anyway. And no one is gonna know you did anything different with the original motor either. When was the last time you saw EPA doing roadside inspections. Fix and get to work
