Did you mark that inspection form with black ink? You’ve got problems if you did. You must give it to your employer, but can’t if it’s destroyed.

All the inspections I received had the line about signing and returning in 15 days.

 

I've had 3 inspections, but all of them in other states. All of them were transmitted to the carrier. I did get one parking ticket in a California rest area, and it was also transmitted to the carrier.

I'm fairly certain your company will receive that report. You might want to call CHP commercial vehicle enforcement division and ask them to confirm. But I'm certain your company will get a copy of that sent to them, and it does show 15+ over on it.

 

That is a list of serious violations. Any 2 in a 3 year period will get you a suspension yes. But they each have different point values. So to say 15 over is classified same as wreckless driving is not totally accurate.


For instance several years ago Ohio wrote me for driving in marked lanes. On the Ohio website it says it’s not a big deal and minimal points I pay it and move on. Arkansas gets the info from Ohio and they don’t have a similar offense so they seen it was a lane violation and automatically flagged it as a serious violation then accessed 2 points on my license. Where a wreckless driving would be 6 and 15 over is 4.

Points matter more so to my insurance company (Great West) than how the violation is flagged by the state.

You broke the law, you deserved the ticket, 16 over in California, no sympathy from me. Man up and deal with it like a big boy. In 27 years I’ve never gotten a moving violation, why because I know what I can get away with, and where I can get away with certain things. I’m smart enough to know not to do 16 over in the communist state of California.

 

A few thoughts …

first if you can’t control your truck, including speed control, consider finding another line of work.

second the chp gave you a level 3 inspection and cited you with a speeding violation, you don’t have to sign it to make it valid,

third you have 24 hours to get that to your carrier (FMCSA 396.9), the ticket is a different issue

fourth deal with the ticket, the carrier will report the failed level 3 inspection with the speeding violation to the insurance company asap if they have one like mine, I have to report specific violations. Many insurance companies would just do that in their annual reporting cycle. You may get fired because of the insurance company having a low tolerance.

 

CA doesn't require them to be sent back. No address/fax/email. Have drivers try to hide CA inspections all the time, we catch them every time SMS is updated.
