Non-CDL use?

    If it looks like a duck and walks like a duck..............Good luck with that one. I get the fellas that try this. How many friends do you know that will haul something 300, 500 or 1,000 miles for free?

    what if you're a drag racer and arent trying to win money? LOL :p

    Sadly i want to build a drag car and it really bugs me how they consider that commercial. I have the perfect solution though: Car will be street legal and simply driven to events. Perfect.


    dieselbear, i did it once. :( This chick i knew, i stored some stuff for her and she moved to illinois and i brought it to her and the total milage was 500. she promised to pay me. She did. $20. Come on. She claims to have sent me a money order for another $20, which is ALMOST reasonable. Almost. I think she really did and that the ### i lived with stole it. So i dont hold it against her because i dont know. But i aint never helping her again.

    Hate to tell ya fellas but the IRS dictates to me what is a business and what is not, NOT the FMSCA. If it ain't on my taxes it aint a business. Trust me, I am speaking from experience as well as numerous discussions with Chicken Coops, roadside LEO's and the FMSCA. I am clean on this one.

    Dictating to you and dictating to what makes the laws for the FMCSA is totally different. The question is not if it's a business or not. The question is if you're commercial under the laws of the road. Don't be stupid and think just because you got away with it that you're right. Just read the laws that pertain to the truck and not taxes.

    Commercial means that is a business. Non-Commercial means that is not a business. I did not get away with anything. I have been stopped by everyone who could possibly even think of pulling of me over. My story is based on fact and not someone's opinion.

    There's no story or opinion on my postings it all comes from FMCSR's §383.5. I suggest you read it. Keep being a know-it-all and see how far you get. One day your run into a LEO that knows the requirements and you'll be crying here again. End trans.

    Fact, the US DOT is not the IRS.

    Fact many carriers use 1099's and classify US DOT employees as contractors for IRS purposes.

    Fact selling horses and winning prize money is commerce and makes you subject to the FMCSR.

    Spout all you want. I speak from factual experience! Sure every DOT officer thinks he has something. But the truth is when I lay it all out I continue on my marry way with no issues. I never said I did not get hassled but again, my experience is that I am 100% legal.

    I saw a Class 8 tractor with a lettering on the side that said private coach, not for hire.

    I looked at the trailer it was pulling and it was a long 53 footer. It was being driven in bad weather and the trailer had a commercial seal on it.


    I really have my doubts that it was a private vehicle.
