Ya know your only digging your hole deeper here right? And while i hate shoulder parkers as much as anyone else playing devils advocate to both sides here. We only have the news report for info here and while most news is at BEST propaganda slanted heavily towards lies.....well its what we have to work with. Hell the driver could have lied to them sure.
Now it says that he was waiting for a tow truck. There are many faults that can instantly deadline a truck especially a "modern" one. For example. When my SCR literally melted my truck lost all power going up 64 in VA in winter so much so i could not even climb the hill luckily i was just past an onramp and was able to drift back onto it to relitive safety. It took the towtruck 17 HOURS to get around to grabbing me just because they were busy cleaning up other wrecks. And this after 10 hours of driving already. So yes i went to sleep, the hell else was i going to do? Sot there awake for 27 hours? My triangles were out, my truck was dead in the water, i had no power, and i was cold. There is a good chance if the guy was near the end of his shift and tired he decided to take a nap while he waited.
Also happened when i blew all the coolant fittings on my engine. Took them 7 hours to get to me in summer because covids and only having 1 guy to drive and with no coolant my truck wouldnt even allow me to START it, just instantly into stop engine. Again i was able to limp it off the road but i was stuck till they got to me so again i took a nap because again the hell else was i going to do? Beat off?
On the other hand, COULD he have lied or the propaganda agent be misinformed? Absolutely. Hell most of that type of driver would happily lie their ### off to get out of a ticket. And most propaganda agents idea of journilism nowadays is "can we make this about trump, anti republican, anti american, anti white or a racism issue? And if so how? If not then ill just jot down whatever because no one will fact check it.
However, without far more details then we HAVE its hard to say so we gotta go off what we do have. That being the guy was a victim, and frankly your digging your heels while insulting others is only going to deepen the fight. So yes is it posible and even likely your right? Absolutely, but most people are going to lean towards the guy who got hit as being a blameless victim.
My question however is why are we trying to assign blame to the guy on the shoulder? Regardless of WHY he was there, why in the name of sweet baby raptor jesus chewing on a donkeys ### did the box truck HIT him? This is the guy you should be lambasting becauae ive never hit a vehicle on the shoulder, most other GOOD truckers have never hit one. So WHY did THAT idiot?

9 times out of 10 im in the sleeper at a shipper/receiver if im waiting, why should i be anywhere else because im broke down?
Is it your contention that the guy just was waiting on a tow truck because he was tired, just decided to park on the shoulder for a nap? Because thats not what the article says, it reports what the officer said, "the box truck guy fell asleep at the wheel and crashed into the guy waiting on a tow"
the officer mentions that the guy waiting on a tow was "actually asleep in his truck" why is that bit of information relevant? Why do you care about THAT and want to crucify HIM instead of the actual guy that caused the accident?

It amazes me how 7 out of 10 trucks work in the daylight while 7 out of 10 shoulder Tragedies are overnight "breakdowns".

I’ve been broke down more than once , some times I had all of 1-2 seconds of warning! Whining about where and when a truck breaks down ,causing it to pull on the shoulder is B.S. Damx Danny, how far will your truck go without power or air - blown steer but, you must’ve a special type of truck that can make it the shop or maybe you can levitate your truck? I’ve stopped in the road because, was no shoulder! But in this case , who’s at fault, the one broke down or the one that left the travel lane and hit broke down truck? As to the sleeper issue, where do you think he should have been, at the back waving everybody around? I just love to be on the shoulder so when someone rides the white line i can get that felling of “ brush of death “ !

Seems like it would be fairly easy for the highway patrol to verify if he was waiting on a tow or not. All they’d need to do is reach out and see if anyone got a call about a broke down truck at that location. That would be something that’s pretty dumb to lie about when you’re involved in a 3 vehicle accident.
