Please enlighten us. I'm actually not trying to be a wise ###. That's one thing I haven't seen mentioned in the forum and for the sake of educational purposes, it may help someone down the line.

 

If you fail a drug test a medical examiner will call you on the phone and inquire as to any medical procedures or prescribe medication. If you validate what you are on and it’s what flagged you. The medical examiner overrides the failed test and you are given the all clear.

 

As a black guy, I wouldn't have been worried about another guy in orientation. To be honest, what would have possibly sent me packing is that load to Virginia the guy took. He ended getting dispatched there twice. That is the only thing out of everything that I read that would have given me pause. The other driver in the motel, who cares? Dispatch? I would've asked for a different one. I also would not get into dialogue about social issues with dispatch. I think tge plaintiff messed up there. I alluded to it earlier, he could have gone somewhere else. There's Melton, Boyd Bros, dozens of other flatbed companies.

 

I highly doubt he would have failed for just anesthesia in the first place, but if he did there was plenty of proof and he would have been cleared for duty. Now abusing pain killers is a different story.

Thank you. That’s an honest answer. I wouldn’t expect anyone to stay for the kind of abuse that he allegedly was receiving. Jobs aren’t that hard to come by now days.

 

Ahhh....I failed a random, and I never got the question other than are you willing to send for another examination, with a fee of course. So if you agree to get the reexamination, then they ask you if you're on anything else?

 

You're right about that, but the plaintiff is all we've got. Objective speaking, I'd be open to hear TMC's side.
