Read between the lines just like the judge/jury will. Lawyers clearly exaggerated some of this story which does a disservice to the plaintiff ESPECIALLY if it goes to a jury.
Did plaintiff experience racism? It had better be documented somehow. He said/she said rarely meets that burden of proof lacking other overwhelming circumstantial evidence. Emails/text messages ALWAYS work better than phone calls or voicemails. Most likely plaintiffs attorney is searching for that settle out of court threshold.
Does racism exist? Absolutely. Not even a debate and those of you denying that are either not very wordly, not particularly educated or part of the problem itself. It's human nature and plain ignorance to not accept what you don't understand.
I'm part of the good old boy "network" because of my birth color where coworkers confide in me about how those Mexicans smell & are lazy or how those blacks are going to ruin their property values and drag us middle class, hard working whites into the ghetto. Having black friends or family members doesn't qualify you as an expert and I'm certainly not pretending to be but God granted me empathy and i use it daily.
I've held my black brothers hand as my other was on the tourniquet i applied when his leg was blown off in the suck. Nothing makes me want to give another person lead poisoning more than baseless virulent hatred based on skin color. So i wait... and watch & hope. Reminded how history repeats itself.

Not gonna lie this filing looks horrible at best. The lawyer that filed it is not someone that I would trust first and foremost. The wording and lay out of the story is pretty bad and lacking based off of a lawsuit I had done on a former company. My lawyer I had was so detailed on every thing that this looks like a child laid it out.
After reading it I find it hard to believe this gentleman would have worked for this company for a year. Anyone with any self respect would have walked out of that company before training or at least during the training on the truck. I know people have horrible experiences with trainers but surely in this day and age you would record the person at least so you could get away from that person if you really wanted that job. I for one could never let anyone speak too me like that regardless of if I needed that job or not.
Then the story on the hillbilly's saying about the ####### being hired from TMC just cracks me up. I see just as many black folks as I do white folks driving for TMC. Last I knew they had been more of a ex military type place and hired more people from getting out of military regardless of color. This is one of the reason they are known to have great (tarping skills) and teach this stuff so hard. So that alone just blows that story line out of the water for me. If the guy did have that happen then he should have turned down that load going back to it regardless. Should have quit on the spot or got fired and then filed a lawsuit. That would have been credible and would have had something that could have stand on with a lawsuit.
Now when it comes to not taking the drug test is the last straw that makes his story even sound worse. I have had the same issues in the past and had that same procedure done and put on meds. They knock you out with gas most of the time and you would have a record of it. So if for any reason you would have a dirty test come back for that drug it would be recorded. The meds he was on would not have anything to do with a dirty test either so no worries on that, Hint the reason the Medical department cleared him to drive while on those drugs.
Chances are the guy was dirty as could be and did not want to get caught. This lawsuit is a way to hopefully get that refusal off his record is my guess with a money grab if possible. My lawyer would be all about a quick settlement since no real evidence is shown. Only way this would not be going that way is if a lot of other employees joined in to form a class action. Unless a class action happens this is gonna be a laughable attempt to sue TMC in my Opinion. -
