The original fine was $236. I had several reasons why I fought it. First I felt like there was not proper notification of the speed limit changes to properly slow down my truck. Second when the officer told me why he pulled me over he said I was going one speed and then when he handed me the ticket it was for a higher speed than what he verbally told me. When I questioned him about why the difference between what was on the ticket and what he told me he pulled me over for he shrugged his shoulders and said if I disagreed with it I would need to take it to court. So I thought great I just got a ticket from some idiot yokel who is trying to make his quota. And the 3rd reason I decided to fight it is because I talked to my company safety manager and was asking his advice because I have no experience with any of this because it was my first ever ticket. When he found out the severity of the ticket he told me that if I wanted to keep my job I had to fight it and get it lowered because their insurance won't allow them to continue my employment. I absolutely love the company I work for and can't say enough good things about them. Out of 11 years of driving they are the best company I have found. So for me $2000 was worth trying to keep my job. Unfortunately for me things didn't go my way in court. I feel like all I can do is shrug my shoulders and try to treat this as a crappy life lesson. I am still really holding on to the hope that the CEO will pull thru for me. My dispatcher and one of the people that works in hr had suggested me going to him because they felt like he would make a exception for me because he really likes me and knows my history. From my understanding I will find out tomorrow whether or not I will be able to keep my job but even if I lose my job I can only say good things about them. They have been really good to me.

I’m just trying to put this in perspective a little bit for the masses out there. This guy has an 11 year driving career that was flawless. Think about that. Day in, day out, hundreds of thousands of miles, all over the country in every kind of weather on every kind of road and he rolls down a hill into a drastic speed transitioning area and doesn’t get the rig slowed down quite in time before he goes over the 30 mph line. And for that his career should be over? Come on man. I’m gonna see what I’ve always said about situations like this. There’s those that have been caught in those that haven’t. That’s really the difference. Yes I know some truckers speed all the time. But even those of us who don’t, occasionally miss a sign or a speed transition and we just got lucky.
If I was you original poster I would fight on. Yeah you’ve already dumped quite a bit of money into this but was a little more? I think you should’ve gone in court and just have tried to reduce the citation to some kind of none moving violation or have them(try) to reduce the speed, but it seems you tried to have it dismissed and/or challenged the court in a county/state that don’t like truckers and the judge to offense to that. I’ve had a red light citation dismiss when I actually contacted the officer before court session if he could reduce my violation to a non moving, he said will see what I can do in court. When my name was called, the judge said Dismiss. I thank the court and officer and was on my way.

Unless your Boss can swing a deal with the insurance company that works for him & them you’ll have to start essentially back at ground zero. Going to a crap company like Western Express or the like. You won’t be able to support your family with a job like that.
With a jump from 65mph to 30mph there should be a step down. I know a county road by me in Jersey that had to be changed because a guy beat a ticket. The original speeds were 50mph dropped to 25mph. They had to install a 40mph zone. So now it’s 50mph, down to 40mph, down to 25mph.
It also reads like there were no “Reduced Speed Ahead” signs. With a drop as large as that i would expect one. I would definitely try to find out about traffic code and what is required signage for that large of a speed gap.
However this works out, i wish you the best. It pisses me off that a guy’s whole career can be thrown away by one little oops, that caused no harm to anyone. I would push the lawyer to study up on case law, and traffic code for signage. Somebody may have beat this same ticket elsewhere in the state and set precedence for your case, or you could prove whoever is responsible for the road to be negligent for lack of signage.
***I do know that traffic code says a sign must be visible to the driver from the drivers seat at 400’. So if signs were obscured they would be unenforceableLast edited: Dec 7, 2022

Your lawyer should be able to handle the appeal based on the braking distance issue and not allowing you, an expert witness to explain it in court.
This would mean that the judge would have to explain to the court why he refused to let you explain this and why he sided with the DA on not allowing an full and complete explanation to happen pertaining to the situation.wis bang and adiablushing Thank this. -
Kansas is the home of Fort Riley. Keri's husband spent close to 6 months there early in his career. I was reading some of the late replies when I remembered something he told me happened a while back. A man stationed at Fort Riley was on his way home in western Oklahoma when he was stopped by a Kansas state trooper. I know I am morphing this thread a bit but Kansas is a state where the Troopers are taught to tell lies. In fact, the Kansas Highway Patrol is currently the defendant in lawsuits over what is called by the ACLU the Kansas Two Step.
As an OTR driver, I have had issues in Kansas. This man from Fort Riley according to my son-in-law spent 2 nights in jail after the trooper did this to him because of some firearms he had. A lawsuit against Kansas is either about to be filed in Federal Court or already has over what happened to this man I was told was black.
Knowing the above and reading the OP lost in court even with an Attorney troubles me greatly. I have no issues with the good folks that call Kansas home! I just think the Kansas Highway Patrol needs a laxative!
