    if you travel through nj or ct with a firearm in your rig, it needs to be locked in a case, inacessable while driving, if it is stored in the manner while driving until you reach a gun friendly state line, you will NOT go to jail.

    there is no FMCsa rule prohibiting.

    MOTOR CARRIER INSPECTER: now i just read your post and your the reason and people like you why several drivers are dead and there has been more then a few , tell them or there familys that there is no need for a gun in a cmv .

    now if your feel like your in jeaperdy because of a fire arm you have every right to secure the weapon to insure your safty i dont care where your at, but just because a driver has a weapon does not put you in jeapordey, are you that insacure? or do you have such a god like attitude that you think everyone is out to get you? somthing is wrong with the picture you paint.

    now i admit that there are some bad drivers out there but i have never met one that would willingly pull a weapon on a law enforcementr officer they may be a bad driver bur few are that stupid.

    ive had the dot put me thrue many inspections both state and federal and never found a need to pull my weapon and for the most part have never had a problem as far as giving a driver hell because he had a weapon you my friend were wrong and in fact you were in violation of law says a lot for you dosent it . you as a law inforcement officer are required to obey the same law as we do and if you dont makes YOU WRONG and as far as giving a driver hell well that might work with some but try it with me i am in no way are afraid of a cop of any kind and i happwen to have the money to back it up.

    and to think clowns like you wonder why the public and yes a driver is part of the public with the same wrights that every other citizen has , as far as colling the state police your within your wrights to do just that if your in fear of your safty although i think that was not the case buy the sound of your post i think your probably from new york and you may get away with that type of enforce ment there but not any place else in the country, any place else in the country the state police still would not take the weapon unless there has been a specific threat then thats another story.

    any body knows that you dont threaten law enforcement and most do not, there may be bad drivers out here but few are stupid drivers and i can tell you this there is no honor in a dishonest cop you bring your problems on yourself and a lot of us wont tolerate it and I AM ONE OF THOSE .

    if a law enforcement ofc. is doing his job he has nothing but my respect but his job is not to be a bully and that i wont tolerate he is no better then anyone else his job is enforcement and that is his only job, when you go beyong the law your no better then a common thief.

    as far as going to newy york or east well you dont have to worry about me going there i dont period i really have no use to go to a dump i dont carry that much trash and i #### sure dont do attitudes and it sounds like you have a good one.

    what i post on this forum is to help other drivers and every thing i say is backed up by law bothe state ands federal statute if you think you are exempt from the law YOU ARE WRONG no one is above the law period.

    if you want to give some one hell , stop my truck and we will see who knows the law. your attitude sucks everone has the right to defend them selves and i mean everyone that is part of the us constatution the liberals haent managed to change that yet all though they do keep trying.

    it kinda makes me wonder what your so afraid of, you carry a gun dont you ? or could it be you lack the courage and the no how to use it to protect yourself and that makes every one that carrys a bad guy , that make a lot of sense your big and bad.

    fortunatly ive met and befrended a lot of cops in my time and in all that time only met one with an attitde like yours and he is no longer a cop.

    consider this if your doing your job and you get a hold of some bad guy that you cant handel who do you think is going to stop and help you without being ask, the first truck driver that comes buy will stop to save your but and i hope its not the driver that you gave hell for your sake .

    my gun stays in my truck, its going to stay in my truck i dont carry it with me but you can bet it is in my truck and it is legal in my truck and you can bet if in the middel of the night some one trys to come in my truck, well he will still be there when the cops get there , been there done that, im just to old for more cuts , holes and bruises takes me to long to heal.

    you might want to change your attitude a little bit might even make you fell better, every body is not out to get you.

    Excellent post. In 14 years of working the worst ghetto in our jurisdiction, on the 12th largest police department in this country, I have yet to EVER have a problem with a citizen carrying under a concealed carry permit. Neither has any officer I have ever spoken to. That being said, if someone informs me they are carrying, I will disarm them for the duration of the stop, check that they have a permit, and finish my business with them before returning their gun to them unloaded. I ask them not to reload until I have left the scene. I also am far more likely to use my discretion by not scratching paper and letting them head down the road with a warning, if they are straight up with me about being armed.

    I have been known to have conversations with people I stop that are carrying a particularly nice gun. What can I say? I have a soft spot for Wilson 1911's :)

    On a side note, I have yet to stop a thug carrying a Glock, H&K, Sig, or any other reputable firearm. Most are packing, Lorcins, Jennings, Davis, or Hi-Points.

    Your job is to enforce laws, not give a driver hell because he carrys protection.

    I was audited at my domicile by the DOT in 2007 (officer who is certified auditor and works for the NC highway patrol and does the DOT audits). They were at my home 1-1/2 hours. I brought up the subject to get a feel of how cops see it and we discussed the firearms in trucks situation, their attitude was very different than yours. I owned the truck and have a CCW that is recognized by 38 states. Meaning it is LEGAL and that is all that counts. I didn't run states where my CCW wasn't recognized.

    To say there is no need for it in a CMV you may as well say there is no need for it in my car either, what is the difference? I own both vehicles and I go into ruffer areas in the CMV than in my car.

    There are dead people who were shot in their CMV during the night. One instance was in Texas where a man was shot by gang members in front of his wife during a robbery. Had he been armed there is a chance he could have survived that situation.

    Cops do not have any more right to use deadly force than a citizen does. The same rules apply for citizens if the need arrises. In NC not one CCW holder has yet been charged with a gun crime, yet people like you want to say there is no need in one place or another. The thought that a 911 call can protect someone is an illusion and nothing more. 911 brings the report taker after the damage is done.

    I have had the NC required class approved by the justice department for CCW and I learned the background requirement for CCW is stricter than the requirement to become a cop. An example, if someone has ever had a restraining order against them they will not be approved to receive a CCW. That would not prevent one from becoming a cop if the department chooses to hire them and it happens a lot.

    You really need to get a clue who is a danger and who isn't. A criminal never would have allowed you to see a weapon in their truck. A person with nothing to hide is why you would see it. I am close friends with several cops, some are high ranking and I can say their view is very different than yours.

    Not true, Daycabber. If anyone has ever had a restraining order against them, based off alleged domestic violence, they may never own/possess/carry firearms again. This applies to cops, military and civilians. That is per Federal law http://en.wikipedia.org/wiki/Domestic_Violence_Offender_Gun_Ban

    Many cops, security and military lost their jobs after that law was enacted. Interestingly, that is the only law I am aware of that punishes you retroactively, meaning, if you had a restraining order placed on you 30 years ago (15 years before the law was even written), and convicted of misdemeanor domestic violence, and did your time, but never been arrested before or since, you became an instant felon the day that law was enacted, if you owned a firearm. There is no exception in the law, so neither police departments, nor branches of the military may circumvent it.

    Just fyi, my background check was a 6 month FBI background. Criminal and credit checks. Talking to neighbors, verifying employment for my entire life, as well as ALL previous residences, release on my medical records so they could check to see if I had a history of psychological problems, polygraph, etc...there is no CCW background that compares. :biggrin_25525:

    Each department has certain leeway in their hiring practices. Some may overlook misdemeanors, past marijuana use, some even overlook some felonies. Thankfully, those departments seem to be few and far between. Also realize that many departments are under federal oversight and are required to hire x number of whatever minorities. This is not a problem as long as standards are not dropped to meet those quotas. A huge problem comes when many departments don't get enough applicants of whichever group to even cover the quota. This puts them in the position of having to take everyone that applies, so they can't maintain standards, and stay within their federal mandates.

    However, one standard they can not drop is the one pertaining to restraining orders.

    sorry sod. while I'm of the same opinion as you about your rights not being better than anyone elses, what makes you think that you have the right to carry on private property that is minus a sign? Granted, the assumption that you can carry on private property is legal, once the owner expresses their wishes that the weapon not be there, you then have the right to either leave, or remove the weapon.no one has the right to over ride another's rights. That's why they are called PERSONAL RIGHTS! IMHO

    I know most of the readers of this forum specifically this thread may not believe this, but I have taken the time to read all 1,138 post to this specifc thread and as I have done so I have noticed many people state that it is illegal to carry a firearm in a cmv. Now as for me I am a gun nut the bigger the bullet the more I want to shoot it but that is just me it may not be the same for some. I have read and read all of these posts noting all of the laws and subsiquent actions of said laws and regulations. In my findings not one law has come up to show that me personally that I can not carry a loaded weapon with me at all times unless in said states that do not allow me to carry a loaded weapon as for those states I have no problem to break down said firearm and put up in a way that would suite there laws. Now if said fire arm is deemed by me prudent to keep my life and save the life of another said fire arm will not be put up to the regulations of the law but only because i deemed it necessary to keep said weapon on my person to protect my life and that of another. I've seen the quote "it is better to be judged by 12, than carried by 6" my thoughts to that line are simple yes it is better to be judged by 12 than carried by 6 but if i must be carried by 6 I will be ###### if the guy that killed me will not be carried by 6 as well. I have my own rule when it comes to weapons and the they should be used and it is very simple. Should you deem it needed to end my life then you yourself have deemed it very necessary for me to end yours in order to save mine once you have made the choice to take mine you have made my choice to take yours. I myself will lose no sleep nor feel any remorse for said person to make a choice to take my life and make me defend myself by taking their life if they feel the need that my life isnt worth living then they themselves have made the decision to deem their life not worth living. I personally feel that if there were more TRUE AMERICANS that carried guns and were allowed to deal with a situation as they saw fit if need be lethal force than so be it we should not have to worry about reprocussions for said actions to save our life or the life of another because we CHOOSE to carry a gun it may not be our god given right to carry a gun but they right was given to us by our founding fathers and the U.S constitution that says in general that we have the right to protect ourselves from harm whether it be foriegn or domestic or in some cases even govermental should that time arise I know that I can sleep safely at night knowing that if I need my fellow brothers in arms whether citizen or military will be there to protect me should I not be able to protect myself and I would do the same for them if it costs me life or career I can feel better about myself at night knowing I did something to make our world a little bit safer and better for our children and grandchildren that will eventually come into this world as should we all feel that if the need arises we will be there to do what we can as much as we can with what we have been given and deemed needed to do the job.

    now im not preaching my opinion is simple the more guns there are floating with law abiding citizens the less likely a murder is to happen where said murderer will not still be there when the cops should decide its time to show up.

    not just my 2 cents but a whole pay checks worth
