Do I need to use ELD if my truck + the load I am carrying is less than 10,000 LB?
Lets say truck gvwr is 12,000
empty is 7500
+ I am taking a load that weigh 2000Lb
total weight is 9500LB
in this case, I am under 10,000LB. Would I need to use ELD?
Is ELD based on GVWR?

If you are engaging in interstate commerce YES because the definition of a commercial vehicle is based on gross vehicle weight rating not actual weight. Any GVWR greater than 10,000 pounds is a commercial vehicle and all FMCSA/DOT regulations apply including hours of service and ELDs.
Also, since most states adopt federal rules as their own, even intrastate commerce usually falls under the same weight to be considered a commercial vehicle.Another Canadian driver and Gridaxe5588 Thank this. -
In my state, they allow it to be registered as 9999LB even though the sticker state 12,400LB.

They come in 3 different rating
1)is 10,000 gvw. This payload is 2,500LB
2) 12,400 which is useless. This one is 4,300 LB
3) 14,200 gvwr which I hardly find for sale. This one the payload is 6,800LB
Either I am going for option 1 or option 3.They all have different business structures -

I don't mean to sound like an arse here but it really is that simple. Just because you want to be an expeditor doesn't mean you get a pass from complying with DOT regulations.
Keep in mind, besides hours of service/ELD anything over 10k GVWR has to comply with all the other rules such as operating authority, insurance, driver qualification and more.
This is why you see so many Ram Promaster or Sprinter vans, they have under 10k GVWR and can fit a full pallet (light weight) inside. No need for the big cutaway box van when you can only haul 2-3k pounds. -
The question is that gvwr is the one they look for even though my load and truck remain under 10k. Am I being clear to you?
truck is rated at 12. empty weight is 7 load weight is 2 total weigh is 9k which is under 10k
because the truck is rated at 12, this means ive to use eld?
