Is ELD based on GVWR?

    Do I need to use ELD if my truck + the load I am carrying is less than 10,000 LB?
    Lets say truck gvwr is 12,000
    empty is 7500
    + I am taking a load that weigh 2000Lb
    total weight is 9500LB
    in this case, I am under 10,000LB. Would I need to use ELD?

    If you are engaging in interstate commerce YES because the definition of a commercial vehicle is based on gross vehicle weight rating not actual weight. Any GVWR greater than 10,000 pounds is a commercial vehicle and all FMCSA/DOT regulations apply including hours of service and ELDs.

    Also, since most states adopt federal rules as their own, even intrastate commerce usually falls under the same weight to be considered a commercial vehicle.

    Can I rerate the truck gvwr?
    In my state, they allow it to be registered as 9999LB even though the sticker state 12,400LB.
    I am not sure if this acceptable by other states

    That's registration weight, that doesn't change the gvwr, just amount of taxes paid The only wat to change the gvwr is the mfg can change it, but they almost never do.

    If $20 a month for the eld is going to kill the business plan, it's not much of a business plan.

    No, as stated by others only the manufacturer can de-rate a truck or trailer.

    it’s not the $20, I want to run as much as possible. ELD would limit me and some days I need to be off duty

    Either I’m doing expedite or caroui
    I need to expedite. ELD is going to limit me. 2005 GM 16ft cutaway is my goal to get
    They come in 3 different rating
    1)is 10,000 gvw. This payload is 2,500LB
    2) 12,400 which is useless. This one is 4,300 LB
    3) 14,200 gvwr which I hardly find for sale. This one the payload is 6,800LB

    Either I am going for option 1 or option 3.They all have different business structures

    ELD doesn't limit crap. The regulations you are choosing to run under limit your hours. ELD is just a way to record the hours. If you can't do it legally, you don't need to be doing it.

    You can't have it both ways. Either you haul really light loads and stay under to 10k GVWR and actual weight to avoid DOT regulations or you haul a higher payload but have to comply with all the rules that everyone else has to comply with.

    I don't mean to sound like an arse here but it really is that simple. Just because you want to be an expeditor doesn't mean you get a pass from complying with DOT regulations.

    Keep in mind, besides hours of service/ELD anything over 10k GVWR has to comply with all the other rules such as operating authority, insurance, driver qualification and more.

    This is why you see so many Ram Promaster or Sprinter vans, they have under 10k GVWR and can fit a full pallet (light weight) inside. No need for the big cutaway box van when you can only haul 2-3k pounds.

    Either I’m doing expedite or Courier. These
    ELD is the hos, I cant be working more than 14hrs a day. right?
    The question is that gvwr is the one they look for even though my load and truck remain under 10k. Am I being clear to you?
    truck is rated at 12. empty weight is 7 load weight is 2 total weigh is 9k which is under 10k
    because the truck is rated at 12, this means ive to use eld?
