Hope someone can answer this question for me. I have been looking a several company web-sites and looking at what there requirements are, I saw one that under the requirements section is said " With the Department of Transportation's Drug and Alcohol Clearinghouse in effect, all applications must create a profile at the fmcsa before being hired"

Do all companies require this? or is it just this particular company.

    Thank you!

All companies. Before you can drive, you have to have a negative report from the clearinghouse.

Only if he took a job in that timeframe. I don't think you need to register if employment was continuous through the time the rule was implemented, although employers may have asked drivers to do it. Now, of course since he's seeking employment.

That's correct. Only need to sign up for a new job. If you keep the same job until you retire (and had it when the clearinghouse started) you will never need to register. For the other 99.99999% of drivers out there, they will need to.

Are CDL drivers required to register for the Clearinghouse?
Drivers are not required to register for the Clearinghouse. However, a driver will need to be registered to provide electronic consent in the Clearinghouse if a prospective or current employer needs to conduct a full query of the driver’s Clearinghouse record—this includes all pre-employment queries.

Hey guys so I just did the first query on myself as an owner operator couple days ago. Unfortunately I missed this dumb requirement before and I’ve been employing myself since 2020.

How deep in a hole am I with this?

If you get audited it might come up, but if you keep up on verifying you didn't fail a drug test (yes, it's silly I know) even in an audit it may not be an issue. At this point it's not worth worrying about.
