    My understanding from reading the article is that she offered restitution after the fact, not before. Meaning she was already paid, stole the animal, then offered to pay for it once they came looking.

    It happened same day as the auction, so I have no idea if funds were actually transferred or not. Being given a check doesn't conclude the transaction (please see the Pespi Points Harrier Jet case).

    Say Bob sells his car at auction, but after the hammer drops he reconsiders the sale and takes the car off the lot before it can be transferred to the buyer. The buyer is willing to void the sale, Bob is willing to compensate the auction house for costs incurred. If those facts are put before a judge, there is no way the judge will grant a search warrant or order the seizure of the car. If by some chance the judge does order the car removes from Bob's possession it would be impounded until the case was resolved - not immediately turned over to the buyer. If it was turned over to the buyer, the buyer would be legally prohibited from making any material changes to the car, including selling it.

    This wasn't about enforcing the law, or justice, or even teaching the child about how contracts and the world work. This was a petty official who got his knickers in a twist and had the ability to misuse public funds to advance his personal adgenda.

    But that's also a heavily edited article meant to gain sympathy for a poor child who lost her best friend.

    It would be interesting to see the actual conversations and know their time frame. I'm curious.

    Mom screwed up big time. The fair grounds auction people were a bunch of Richards but it’s definitely on the mom.
