    Werner Appeal of $89.7 Million Verdict Denied | Transport Topics (ttnews.com)

    a pickup truck driven by a friend of the plaintiff lost control on a slick interstate, traveled across the highway median and collided with a Werner tractor traveling on the opposite stretch of road.

    Werner’s attorneys wrote in a court pleading: “At the time of this accident, Shiraz Ali was proceeding in his lane, in control of a Werner tractor-trailer and well below the speed limit, when the [plaintiff’s] vehicle suddenly careened into his path, leaving him no time to avoid a collision.”

    I am not understanding this at all.........so, you're driving down the road minding your own business, in your own lane, and below the speed limit, and some dude hits you, and you are responsible????????

    this was a long time ago, posted here in fact, and i believe its a railroad job against Werner.

    all the lawyers see is big bucks from big trucks.

    they could care less about the trucker, in his own lane, and the other driver causing the crash

    I think the suing party won by arguing that the Werner truck shouldn’t have been there to start with because of bad weather not sure if they already prohibited trucks from traveling.

    If the truck shouldn't have been there, the car shouldn't have either. In non-clown world they'd cancel each other out.

    Werner may have to appeal this to the Texas State Supreme Court.

    They won because they found a jury that hates trucks. There is zero reason that truck could not have been there. No, the road wasn't shut down to trucks, or any vehicles. The only warning in effect was the boilerplate "drive with caution" one. Heck, even after being hit the truck driver never lost control of the truck. This is 100% the guy who died fault, but because deep pockets and general hate of trucks on the road Werner lost.

    The argument was that it's suggested in available materials (Texas state CDL license exam manual) that in the event of freezing rain, the safe speed for a truck is a "crawl", 10 to 15 MPH. The Werner truck was doing 43 MPH, in reality, too fast for freezing rain.

    Werner's attorneys argued that their driver was doing "well below the speed limit" but, remember, drivers have to drive a safe speed for conditions which is what the plaintiff's attorney argued.

    Still, Werner and the truck driver got shafted. Obviously, the plaintiff was driving too fast for conditions and the driver was unlicensed. This article has some details that the other article doesn't.

    Might have been the argument, but as there was never any such passage in the Texas cdl manual the argument is bs.

    Yet the truck maintained contol while he was hit by an out of control vehicle. Doesn't take rocket appliances to see the situation is messed up.

    In addition to Salinas making statements suggesting guilt and responsibility, a Texas Department of Public Safety trooper defended Ali’s actions. Trooper Villareal, a 17-year veteran who investigated the accident, concluded “this is truly an accident,” Ali “didn’t do anything wrong,” and there was nothing Ali “could have done to avoid the collision.” A higher-ranking trooper who approved the report concurred.
