I worked for this company for 13 months was terminated yesterday, was a contractor (with bad grammar) here is where the story begins this company pays everyone as a contractor regardless of what you do, i drove locally was home every day and was paid 550 starting out with an ending salary of 600 per week. i honestly never had any problems until thursday the 3rd i believe, i was asked if i was willing to work late ie...break the law and work 17 hours and be paid some extra money 15$ per hour to which i said ok. who hoinestly cares about dot laws anyways when your home everyday. i asked my then employer if i could be paid for it on the check issued the next day which had never been a problem before to which i was told ok ....and not in a polite manner keep in mind it had never been a problem before i had honestly been paid not only early for doing extra work before but had been paid before the work was even completed ie...weekend work. so i did the work and worked till 1145 at night having went in at 0700 or so...that all went ok till the end of the next day came. i did everything asked of me the next day and at the end of the day i asked for the check for the work i had done the night before, here is where it got interesting...i was called in by a dispatcher and told i was fired for my bad attitude, tghe dispatcher told me to talk to the boss shawn williams and see what we could work out to which i replied ok ....i talked to him for about 5 minutes quickly realized there was nothing i could say to convince him not to fire me and left, telling him i did need to talk to him about one last thing, 15 minutes or so later i called him and told him i would be filing an irs form ss-8 against him due to the fact that i was not a contractor according to the irs rules and that if he paid me all the monies due for my taxes plus 4867.00$ back for an accident i had had the form would be filed he replied in numerous calls that he would "say i refused to take a drug test, report me for falsifying documents to my apartment complex ...i live in income controlled housing to thich he had printed up the documents i have them, he also said he would have my license revoked (funny i got mine from swift and it was not valid as of july 09) he had my fiance so worked up from his battering she was in tears. all in all i would avoid them like the plague they portray it like your making more because they are not taking taxes out until you get the bill from the irs could out right careless if they intimidate you or about the quality of equipment you operate and moreless just do not care as long as you get the job done ie...i drove with a bad air suspension leveler for 3 months and all summer last year with no air conditioning ...i could go on and on but i think and hope enough said
could anyone tell me how an ss-8 works exactly it might be the bright spot in my day

typical goverment agency they are open monday through friday but thanks for the reply any idea what they can or will do and should i tell them he knowingly had me drive without a cdl

YOU SHOULD CARE ABOUT DOT LAWS! They are in place for your saftey and the General public. So many good drivers out there now out of work for refusing to break laws and some scum like you says you don't care to commit the felonies and misdemanors to pad the pockects of a company that should be shut down. You attitude is horrid and I hope you have to stay at home a while to think about it. You also admitt commiting welfare fraud by living in a rent controlled apartment building, while having a 30K a year JOB!

Your not mistaking anything there: Guy is driving without CDL, says FMCR regs are not important and he ignores them, section 8 welfare fraud, proudly exclaims he drove unsafe equipment, worked for a bottom feeder, and now wants help and advice from drivers to get back on the road. I am glad he is off. No one forced him to drive anything that illegal he chose to. It's not like he accepted control of a truck that needed a new light and was going to change bulbs down the road before it got dark. I just wish I had his name and truck number that is required to put in a complaint with the DOT on the Federal Level because he never needs to be back on the road if he is telling the truth.aladdin sane and Beechvtail Thank this. -

First of all you need to contact your state employment office or as they call here in Missouri the Dept of Labor. Swift is in the middle of a big law suit over the issue of lease contractors verse employee. I might even make a call to the Attorney generals office and make the m aware of this issue. I would also contact the IRS and tell them you will work with them and show them what he is doing. They may go after him for filing false federal documents and also defrauding the federal government.

If you had no CDL then you are really at fault. Because had you killed or injured someone on the road you would be going straight to prison.

YOW! This guy skirts laws on so many levels. Sounds like he got burned by someone else who goes through life with the same attitude. I think both have promising futures in the trucking industry on the management side. No CDL or integrity required.
