The whole overweight situation was Mi-Mi. Only the IFTA matter was another day entering OH. And the truck didn't have to appear overweight, when going through the scales at the weigh station, it was clear. I still don't know why he couldn't just let us off load the weight like everyone else says is the norm.

We didn't admit it, and we actually didn't know anyway. We even have texts between the driver and the shipper telling them they overloaded us and them saying how they had no idea their weight values were off. We are taking this to court with us.

OK I see what's going on, your truck isn't a <26K gvw truck, it is a 32k, right?
What does the sticker say on the pillar or on the door?
This is what matters most, not the plate.
You can not claim it is a <26k truck if it has a GVW over 26k in Michigan.
The plate is about fees and taxes, nothing more.
They won't let you run a truck that isn't plated right, the queen and her minions want their money.
Sorry about the rhetoric I used, but something isn't right.
So here is what I suggest, you may already have done this, but I'll assume you haven't. Get that sticker number, take the truck unloaded with a full tank, and your driver to the nearest Cat scale and get it weighed. Then you subtract what it weighs from the sticker number. This will tell you what you can haul.
The other thing is this - you can get a "Single Trip Fuel Permit" from Ohio to haul into Ohio, the permit should be something like $15. -

I can’t speak to Michigan, but I’m Missouri you can register your truck for what ever you want. Gvwr has no impact. I drove a straight truck registered at 54 with a gvwr of 46.

If you have a box truck with air bag rear suspension get yourself a axle load gauge or a rite weigh system and you’ll know instantly if your heavy on the drives ..

Actually it does matter, registration is only about the fees, not the actual weight you can carry legally. This is a huge liability for you, get into an accident in any state in the country and you are now going to face lawyers who will look for millions in a settlement. This is a given with the number of cases against commercial operations in each state growing.

Tejas the same. We buy 26,000 gvw’s because it is lots cheaper and re spring them to handle 33,000. Register them for 33,000. State don’t care as long as you are not over what you paid them for. We have done the same with higher gvw trucks as well when they get shuffled around for different duties or retired from service. Register them for 26,000 so the non cdl guys can use them.jamespmack and Sons Hero Thank this.
