    Providing everything is up to board he’s not, fuel surcharge goes to the truck, not the driver, not the owner, without knowing how the office billed it, whether all in or line haul/fuel, and how he is getting paid\what his contract says it’s hard to give a straight answer here

    If you signed the contract, it's legal. Read your contract. In the future, don't sign any contract until you read and understand all of it.

    Your question was about whether or not something is LEGAL. To answer your question, you would have to tell us what you and the company agreed to in the operating contract that you signed. If they are doing according to the contract, then yes they are doing it the legal way.

    Now, @Iamoverit stated that there’s no freaking way that he would be paying for fuel. You got mad about that and apparently that’s one of the sticking points in your opening post. If you don’t know whether or not you agreed to this, via the operating contract, you ought to be ashamed. Find someone who wears a size 13 shoe or bigger and politely ask him to kick you for your horrible business decisions.

    The answer is quite simple. As has been said over and over, what does the contract say?

    That said there’s a somewhat quick way to see if you’re in the ball park. Most by the mile pay is 50-60 cpm.

    So for grins and giggles let’s assume an average of 55 cpm.

    Next multiply .55 times the number of miles driven in a given period. For say of that argument the number is 100,000. So then .55 x 100,000 is 55,000.

    Now take a look at your gross salary for the same 36 week period. Is it less than $55,000? If so, you’re getting screwed. If your gross pay is more than $55,000 then you are doing better than average.
