Considering the track has been there for 65 years, this is unquestionably a matter of Coming to the Nuisance. "So, Mr. Moneybags, you claim that you had no way of knowing there was a track here when you bought your McMansion?"

Whether the track has the resources and willingness to fight this lawsuit, or decide it's better to switch than fight and just sell out to a developer, remains to be seen. Bridgehampton Race Circuit suffered a similar fate due to suburbanization of Long Island's East End, finally closing in 1999. Most of the site is now a golf course, apparently a less offensive neighbor.

 

Man, there needs to be a "Dude, I was here first" law......

NIMBYism is when you want circumstances imposed on others that you do not want to apply to yourself. An example would be when you support unfettered illegal immigration so long as the immigrants do not show up in the vicinity of where you live and/or directly interfere with your life, while it is very obvious that they do impact the lives of others that you show indifference to.

This is more a case of blatant stupidity and people looking for something to blame instead of taking responsibility for willfully putting themselves into a position that they now complain about as if it is someone else's fault.

 

The worst thing is they have won multiple lawsuits in these situations. Our legal system is broken.
