Prime ordered to reinstate driver

    Also, the judge ruled that Prime DID in fact have cause to fire her, but the inclusion of the Donner Pass incident was the problem.

    Also, after reading the decision, it appears as if the Labor Dept. ruled against her, and this was on an appeal to an administrative law judge, but I could be wrong about that.

    In all big companys there will be some idot FM that trys to push drivers to drive in bad weather, bottomline, if you don't feel safe pull over. I have had a night Dispatcher tell me to get rolling in bad weather before, i just got his name, unplug my qualcomm, turned off the phone, and went to bed. Then the next day let my FM know what happen. Night dispatcher was fired.

    DOT Offices? I sure didn't see that when I read the decision. Sounds like OOIDA is exaggerating a little. Must be sore that one person won a lawsuit against Prime, and it wasn't them that filed it. :biggrin_25526:

    I'd fire you in a heartbeat if you headed to Medford OR by taking a right at SLC. Don't know why she was crossing Donner though, 395 the numbers would have been faster.

    You are all missing the larger, bigger, in-your-face problem here.

    The DM gets fined for a late load no matter what because the company says so. THIS IS A BIG PROBLEM. Should be illegal, and I hope ALL the DM that have ever been fined from Prime sues them for illegally taking their money.

    No way in hell should the company be able to dock your pay if safety is your NUMBER ONE GOAL, like all companies claim it is.

    OOIDA is still "smarting" from the last lawsuit where the judge ordered them to pay Prime's attorney fees.

    With all the shady folks out there these days the DM and driver probably cooked the scheme up and split the money 60/40. :biggrin_25522:

    Even the crappy DM's that do push drivers to drive unsafe AND illegal know enough not to send the message on Qualcomm.
