Motorcycle crash- citation

    You can't get jail time for a traffic infraction. DUI is not a traffic infraction. It is a crime to drive drunk. If its criminal speed, its criminal because of the amount of speed involved. Simple speeding IS NOT A CRIMINAL OFFENSE. In most places 20-25 over is criminal speed. Otherwise, its simply a traffic infraction. I got a ticket for 10 over on my old motorcycle. It was NOT A CRIMINAL OFFENSE.

    They don't want to make every single traffic ticket to be criminal because that opens up a pandoras box of crap they have to go through now. They have to then have a plea date, then you have to have access to a lawyer, etc. If nobody reads you your miranda rights when you get your traffic ticket, you are NOT receiving a criminal citation.

    Get a lawyer

    if you didn’t strike another vehicle or damage any property besides your own bike , and you were transported by ambulance from the scene , the prosecutor or judge will very likely dismiss the ticket

    Again, each state, court and situation is different. In 15 states, Nevada and Arkansas being two examples, speeding and other traffic violations are misdemeanors, theoretically jail time is possible. In most states, repeat traffic violations in the same year can result in jail time. In Ohio, 3 speeding tickets in 1 year can result in 30 days in jail. Also, in some states, if you have a CDL, even if the violation didn't occur in a commercial vehicle, the court can enhance the charge and bump it to a misdemeanor.

    Ok did not have to hire a lawyer. But they know what I'm trying to do. But I'm ok. It was a hard decision, but thanks to all for the help. He is correct, some serious hit and run.
