First off, the forum is named "Trucker Legal Advice". You have to start somewhere. So he came here to get an idea on what to do. Only problem is the only people to answer this trucker were idiots who are most likely sitting in a truck stop bored to death and have decided to bash this truck for trying. Great support there guys. I am sure he appreciated it.
I personally was hoping someone with some knowledge on the legal system had answered this post. I have a team driver driving with an owner/operator. Since everyone I know in the trucking industry is paid by a 1099-MISC, I thought that was how to pay the team driver.
The Department of Employment could not decide if the team driver was an independent contractor or an employee, so they chose employee. Now I have to change how I am doing things plus pay the back taxes owed.
After paying the taxes, worker's comp, & unemployment on on the team driver, paying the truck payment, fuel, etc., I still have to save up to 20% of what is left over to pay the quarterly taxes. How in the hell does a trucker make any money after doing all that?!!
Well, going to try to do it this year and see if we survive. Would have loved to have gotten some advice here, but it is obvious all you get here are truckers who have no one else to attack, so they attack someone trying to better themselves.
Thanks for the support -
This was my advice earlier. Where is the bashing? I believe my advice is in accordance with IRS regulations, and offers ways to abide by those regulations.
