A company can put anything on your DAC that they want to.
Now follow this...... it doesn't matter if it was an "unjust termination" or not. The reason that they fired you was for log violations. They can do that, virtually all non-unionized jobs are what are called "at will employment" meaning the the company can fire you at any time for any reason and, they can report that information to DAC.
As far as the "unjust termination" thing goes what that means is not necessarily that they fired you for an "unjust" reason, it usually means that they did it in an "unjust way".
Of course they contested your unemployment claim. Umemployment is a form of insurance paid by the employer. Just like with any other type of insurance, the more claims, the higher the premium. Most companies have a policy of contesting all unemployment claims period unless, they are from lay offs or downsizings.
So because they fired you for log violations, which is apparently a violation of company policy (duh), in their eyes, you are not eligible for rehire with them and, they get to reprt all of this information to DAC.
Now for the good news. You can contact DAC and respond to the company's report by contesting the information that they posted. You get to tell your side of the story in other words. Especially valuable if you have documentation from unemployment that they considered your termination to be "unjust". Once you get this handled, potential employers will be able to see both sides of the story on you DAC. However it is my understanding that this takes some time and you have to jump through a few hoops to do it.
Your only other recourse is to hire a Lawyer and contest the claim which, may or may not work and could be costly. This might be the only way you might get the info removed.

Unfortunately the Unemployment Security Commision has nothing to do with what is and isn't on your DAC. It's a shame that companies are allowed to put things on it at will without any notifcation to the individual. There otta be a law.
Just like a credit report the burden lies on you to dispute any entry on the report..
I would suggest getting a copy of your report..of which you are entiled to by making a request.. Do a search on GOOGLE for DAC Report.. you should find everything you need to know there. Good Luck.Baack Thanks this. -
dac goes by the name hireright now. you log onto there web site and submit a request for you dac report. at the same time you can request all reports /files dac has on you it take about 15days to receive the reports and syou can dispute them them. you are entitled to 1 free one a year and every time a company runs your dac your entittled to a copy of what they sent to that company. but you have to request it and state the company that asked for the report. this is how i get my reports ive got 3 of them since january.

I see a lot of people on this site fired for information the companys find on them after they are in orientation and some after they have almost completed their instructor training.... many of the people go to school and are placed with driving companies that aprove them and pay for the schooling/training all or most..... My question is do they not do checks before they go to the schools ?, or at least do them all before they are set up for orientations? or approved to be sponsered by the truck company..
I personelly have nothing to hide, but I see a lot of people on here,that get sponsered, then way down the road get fired because of information not reported, seems it would of all been checked before everyone has wasted time and money.. -

Question: Is it worth doing OTR?
Question: Should I persue a local hire employment, if already accepted
Question: Is $14/hr local a good starter amount if able to at least 50/hr weeks
Question: Is CSA 2010, Hireright going to kill this industry with all the checks and balances, or open up more career options with the lose of so many of the senior drivers with bad history being pushed out of the industry? -
Answer: Maybe. Local is not necessarily all it is cracked up to be. In a lot of cases you'll only be off 10 hours a day. Granted you'll be home almost every night but, you'll have to commute to and from the yard etc.. so think before you apply. Plus some local jobs are hard to get as a rookie.
Answer: Yeah I guess at 50 hours per week straight time that's $700.00 before taxes and, if they pay hourly, most likely they pay OT. Better than a lot of OTR guys are making right now.
Answer: I don't think that CSA 2010 or Dac (in any of its incarnations) will kill the industry. However, I think that the industry will be reinvented yey again to comply with the new standards. The more things change, the more they stay the same. IMO.

not sure if I posed this in the right place, but I'm curious if there is any way to opt out of DAC? maybe I'm just paranoid but I do not consent to USIS maintaining any sort of file on me, my family's company didn't use it when we were in business, I think TMC uses it and it will be interesting to see what they put on it when I quit. innoncent question, the whole notion of a 3rd party company having this sort of info just creeps me out a little. I suppose there is no way out of it.

The only way to "opt out" is to never work for any company that uses it. It is viewed upon as a form of credit report...where the various credit reporting agencies maintain files on anyone who has ever taken out a loan or done any banking with any financial institution which reports to those agencies.
Yeah, sometimes crazy stuff makes it's way onto those DAC reports...the people making entries onto those reports are far less professional than those making entries onto your credit report. -
it is not a choice for drivers. you just have to find companies that don't use it.
