regulation history question. Overtime for drivers?

    Does anyone know why, how drivers are not paid overtime after 40 hours? I know the regulations, but what was the reasoning behind them???
    Additionally what would it take to change this practice? (AND DONT PREACH ABOUT YOUR UNIONS! )

    Typically drivers make a wage above minimum wage. Since paying drivrs by the hour would have no impact on their ability to earn the federal minimum wage for the hours worked they are excepted from the FLCA.

    May careers are FLCA excepted, computers, farmers, and management are a few that come to mind.

    In my current position I am FLCA exempt.

    I have reviewed various compaies that pay in every imaginable scale. No one ever appears to be happy with the amount of money they make and want more. I have discovered false logs at companies that pay by the hour as the driver wanted more hours to earn more money.

    I dont think its just the unions that will "work for you" because sometimes they dont. Maybe if more drivers would start taking action instead of just complaining about things then maybe something can happen. Start writing letters to the Labor Secretary and Dept of Transportation, your congressman. The way I understand it, Washington state law now requires Washington state based trucking companies to bay overtime to drivers based on a 40 week. How many of you Washington drivers know that? Not sure how alot of the pay would work out if they decided your base pay was minimum wage. Anyway Dave, I dont know what the reasoning was behind their thinking, but that was determined back in 1935 so if drivers got on the band wagon and started contacting representatives and departments, maybe something could change for the better.

    Why do people expect the government or some other entity backed by their weapons decide their pay?


    If you are not making what you feel you should be for the work you perform find something else!

    I agree. But why did the government decide that a certain class of workers should be paid less for more hours of work than the next class of workers. I dont expect the gov't to decide my pay. But I do think the playing field should be level and the laws should reflect that. Why should the gov't be able to demand John Smith who works 45 hours per week shall be granted 5 hours overtime while Joe Smith who works 60 hours per week is not worthy. I'm not a big fan of Big Brother but if they make laws that discriminate against a good portion of the population that aint right

    Let me if I can guide this thread back to the question I asked. I know all too well the current day situation, what I don't know is how we got exempted or why or who is to blame for it. That is the question I was asking.

    I don't know who is to blame but I agree it is BS that driver's dont get paid overtime. Under the current system and the way the industry is, I don't see them changing anything. So many carriers are cutting rates to get get loads, I personally do not see how they would pay overtime. Maybe what they should do is raise the wages of drivers one way or another.

    Joe Smith is not being paid to work 60 hours. He is being paid to drive the roughly 3000 miles 60 hours would garner.

    If you want to be paid by the hour find a job that you punch a clock.

    Let's try this again! I have a job that pays me by the hour, quite well actually, but I am NOT eligible to be paid overtime but I AM EXPECTED to work over 40 hours a week! I just want to understand how, why, and who is responsible for situation. I know its legal because we are involved in "interstate commerce" but when, why, how, and who got us BENT OVER THE FUEL TANK WITH NO LUBE????
    Surely someone knows the history behind this royal butt canoodling (trying to word that delicately so I don't get censored or reprimanded. )
