    Werner Wins $100M Nuclear Verdict Reversal by Texas Court - TT

    “That singular and robustly explanatory fact fully explains why the accident happened and who is responsible for the resulting injuries. Because no further explanation is reasonably necessary to substantially explain the origins of this accident or to assign responsibility for the plaintiffs’ injuries, the rule of ‘proximate causation’ does not permit a fact finder to search for other, subordinate actors in the causal chain and assign liability to them.”

    Simply put, just because he was there doesn't make it his fault.
    Sometimes the little guy wins.

    "The high court said that nothing the Werner driver, Shiraz Ali, did or didn’t do contributed to the pickup truck hitting ice, losing control, veering into the median and entering oncoming traffic on an interstate highway."

    Glad this absurd verdict was overturned.

    The $100 million award was absurd.

    The reasoning for blaming Werner was absurd.

    That it took over a decade to resolve this matter was absurd.

    Justice has finally prevailed.

    the lawyer for the pick up truck driver's family, must have sold the family a bunch of hopes and dreams, that the trucker maybe was in some sort of violation of his hours of service, or speeding, to have caused the Werner driver of "being there, when he should not have been there"......

    i gotta say, as much as i really do not have respect for many mega trucking companies, this is good that Werner won.

    It's the right decision, I guess they just wanted to see Werner cry some crocodile tears. I wonder how much they paid the legal team, lawyers are always happy @ $,1000 an hour

    Maybe they can now afford to re-instate the matching 401K funds for their participating drivers.

    Hope Werner goes after the plaintiffs for every penny they have for such a blatantly frivolous lawsuit.

    And I hope the driver does, too. There's no telling how much he had to spend in lawyer's fees, lost income, etc.

    Glad to see that the Texas Supreme Court saw thru all the BS this case curtailed!
