Well, was listening to the Lockridge report today and they had a guy on who either owned or ran a company that is helping the trucking companies get ready for this CSA2010. Found out, that as of this time, I am screwed big time!!!! Both of my accidents will count against me and they are making no differentiation between preventable and non-preventable!!! Sux to be me. Supposedly, they are going to go back and revisit this and come up with some kind of a weighing system. Don't know what ya'll think but my opinion is, it wasn't MY fault, shouldn't count against ME at all!!!!
Once again I had no preplanafter my drop. Said MI was slow at this time. Bout 4 hrs into my break, QC goes nuts. Good thing I wasn't asleep yet or I wouldn't have heard it. Sent me to the wally world in Grove City, MO with a load going to Plainview, TX. Sure hope I can get there early enough to grab a tlr. Already know, well anyway, pretty sure, I'll be getting a meat load. Hope I don't have to sit for 3 days this time!!!!
JJ, does 1BAd run mostly during the day? Ought to call and harass him.
KH, sorry bout missing your call the other day. Think the hands free headset died. Tried to answer but didn't hear anything.

I had heard that a while back Panhandle, but I did not want to go against what you posted your safety guy said. I was hoping it would get changed before it mattered.
It is one of the BIG things that OOIDA and ATA are fighting on CSA2010. Epically since 75%+ of the accidents trucks are involved in are not the drivers fault.
Of course that is the full reason why the safety groups and the FMCSA want all accidents listed, since they know that no company will ever get in trouble due to at fault accidents, so that basic would be worthless.

    Anyway.
I have not been on all week. Crappy miles this week. I guess we do not have enough trucks out of the 2 terminals in the Northeast div. So I was stuck here all week with short loads. I will break 2000 for the week, but that is it. At least almost all the miles are what the company calls "green miles" so I get an extra .04 cpm. Though it should be like .10 cpm more.
Have a 2 stop in the morning, second one is up north of white plains NY, near sing sing prison. Then picking up in Middletown NY for a Tues delivery in Detroit that I can bring home.

    PF,

No problem man. Things happen in life. I hope they will treat both of your cases on a case by case basis and give you zero points. Sometimes the law is in our favor and sometimes it is out to get us. Good luck.

That is what part of the arguments are that ATA is giving them. Right now there is no way of treating accidents different. To CSA it makes no difference who is at fault, and the FMCSA is very very against changing that.
They say that the numbers show that certain drivers are more prone to getting in accidents, regardless of fault.
What I do not think they are looking at is into the numbers. What lanes are those drivers running, what miles, what weight of loads. All of these are important, and all can lead to more exposure to accidents.

The NTSB says that not at fault accidents will be listed as part of the company safety standards assessment but no points will be assessed towards the driver or the Company. the only time points will be assessed in a not at fault accident is if there were a Log violation or a equipment violation that was found on the non damaged portion of the equipment such as missing or faulty safety equipment Example missing or broken warning triangles or unserviceable fire extinguisher. They also go on to say that if the FMCSA tries to assess points to not at fault drivers and companies with no violations at the the scene of the accident before the CSA Changes it that it will open the door to a whole bunch of Civil lawsuits by the ATA , trucking companies and driver advocates and drivers who have the means to dispute the claim. what will happen is that the FMCSA will try and enforce it like it currently stands but will be faced with court ordered injunctions to refrain from charging companies and drivers for not at fault accidents and will have to reverse point counts for those that were effected by it. The Senator who is the Chairman of the transportaion committee is investigating certian aspects of the CSA2010 as a result of many of his constituants who are affected by this were complaining about the effects. what he will do about it remains to be seen. well I am at the T/A in Boise even though i am so close to home i have to deliver in the am and id have to get up real early to drive in. So i will stay the night in the truck and deliver the load in the morning and then go home for my hometime. Jess will come get me from the yard after i get unloaded. I woke up this morning in Wamsutter, Wy and it was snowing but not enough to effect the driving, it was also snowing on and off in Utah but it was not sticking but the wind did push me around a little. well thats it for now stay safe and keep your rigs out of the comidian strip JJ.
