I had assumed that the accident was in your personal vehicle..

If it is listed on your PSP as an accident there’s nothing you can do about it and that’s what carrier’s are seeing…and why you’re getting rejected. Why would they bother hiring you when they have an over abundance of drivers looking for work.

I would still file a dispute and try getting it removed from your mvr. On the PSP report it’ll show for 5 years fault or no fault.

It’s a bum rap for drivers who aren’t at fault and they don’t add details to the psp.

I had one stuck on mine after I hit a cow and had to have the truck towed.

It's about insurance. Thats what's causing these companies to reject you. If the companies had their way, theyd take you now. Once insurance run your MVR, and they see the accident that you had involvement in. Its unfortunate, but drivers get penalized even if they aren't at fault. After 3 years, then you won't be penalized. You still can get hired somewhere, but it may not be the cream of the crop.

It's called contributory negligence. (insurance speak) . You can be minding your own business while driving and be involved in an accident, which technically isn't your fault. However, if you weren't in that spot when the accident occured, you would not have been involved in the accident. As an example, a cluster of vehicles travelling down the highway doing 70mph, then one drifts out of his lane, (distracted?) and causes 2 vehicles to collide, the insurance co can and will say if you weren't part of that group of vehicles, you wouldn't have been involved. You should see this beforehand and back it down somewhat in case one vehicle messes up (all it takes is one) and BAMM ! Accident. Take notice next time you're on the highway in heavy traffic, moving along at speed limit, just think if someone messes up, this cluster of vehicles gonna' get in a tangle real quick. The insurance co's mindset ? Anticipate a problem and avoid the problem.

I really appreciate this. I’ll start by saying I wish I’d found TTR back in 2020 when I started with a Class B. So I do have an accident from 2022, dude had his gooseneck parked in the street and I hit it with the trash truck. I accept responsibility for this one fully. I paid my fine for hitting the trailer, he paid his for city ordinance violation for parking a trailer in a public roadway, and we moved on. I never had any trouble getting hired after that. Now all of a sudden, some idiot decides to brake check/u-turn in front of me and the lady that hit me, and it goes on my record. I have no problem being rejected for something that was my fault and I owned up to, but when a trooper tells me and the lady that hit me that neither of us are at fault, and then it shows up on my MVR and is keeping me from getting hired, then it kind of runs me hot. They really weren’t lying when I first went through CDL training and they told me that you’re the one with the CDL, 99% of the time they’ll make it your fault even when it’s not.

Thanks for this explanation. I am quite cautious when driving (following distance, checking mirrors, etc.) even in my personal car. This particular incident was an empty highway except for me, the guy up ahead who braked and u-turned out of nowhere, and the lady behind and to the left of me. I’m just glad I check my mirrors constantly or it could’ve been a really bad day. Once he whipped over into her lane, I checked her in my mirror and sped up trying to give her some room, and I wholeheartedly believe that had I not sped up, she’d have gone under my tandems instead of bouncing off of my tire. God was definitely looking out that day.

Insurance also used to look a paper logs. "If you hadn't cheated on your log for that one 2 minute time frame, you wouldn't have been in that exact place where the wreck occurred."

One of the biggest stresses I had in trucking was bearing the consequences of other people's actions all day, every day. Traffic, parking, no detention pay, doing without food, sleep, showers, etc while everyone causing these things to happen pay no penalty and spend their time telling the next customer the freight is late because I'm probably napping somewhere instead of doing my job.
