Fired "Reckless Driving"

    I've been with US Xpress for 3 years now incidents, accidents, warnings etc. A few days ago someone was in my blind spot and I got over unfortunately which caused the drive to get over onside of the road. I didn't cause and accident nor didn't I damage and property. The guy called in on me with video and I was rerouted to Dallas safety and terminated. They said they will put it as reckless driving which will show on my DAC report. How do I go about fighting this? I'm aware a job can terminate you for anything "at will". This was my first mistake ever driving for 3 years. I didn't even get a warning. My wife said they are probably trying to reduce headcount and I was caught in the fire. I live in louisiana and since Nov they have had issues with getting me loads home and I would literally have to drive from louisiana south LA to other states to pick up a trailer. I have been getting a lot of night loads and sitting. I have barley made 2000 miles since the switch to a new dispatcher in Nov. What other companies can I apply for and how do I fight this on my DAC.

    To understand....when you changed lanes, the car was in your blind spot. You didn't see them initially, but when you made the lane change you ran them off the road?

    Wish you were a bit more clear with your typing it's really hard to follow what you're asking...first you say you're fired then say it's been tough getting loads for Louisiana.... pretty sure there's plenty of carriers i Louisiana and Texas that would be able to accommodate you...

    I didn't spend more than a month and some change with US Xpress, but shouts out to you for lasting 3 whole years at a company that doesn't pay worth a ####. You can contact HireRight to dispute misinfo on your DAC. I had a non-contact incident (a vehicle swerving to avoid collision) at JB back in 2016 that they'd put down as a "trailer detaching from a tractor while in-transit". USA Truck hired directly after I got terminated and I was able to get that removed off my DAC. The info that trucking companies on the PSP is a different story though. I think you'd have to contact DataQ to dispute that

    First off, request a free copy of your Hire Right and Driver IQ reports to see if there's any false information. You can dispute any false information on your reports.. Hire Right will then present the disputed information to their customer, your former employer.. If the company say no that record is reporting correctly.. that's it.. You now have to file the lawsuit in court, I recommend Paul Taylor and his team at the Truckers Justice Center.. Once they confirm the record then all you can do is submit a rebuttal statement to Hire Right refuting their allegation.. most likely the DAC report would eventually be corrected after you settle out of court...almost all cases settle folks..a lot of these megas hire law firms at $1000 an hour..they'll settle the case most likely..     Fight the report on a technicality..have a lawyer do it. Find an employment attorney, don’t be just another chump putting up with this crap.

    It would be considered careless driving not reckless driving. There’s a big difference.
