Everyone who has a legal CDL , no matter if they are even legal, got it from their local Department of licensing, DOL, DMV etc. They are all supposed to give the written CDL test in English ONLY in the USA.
This is the first in line for all of the problems. Every single DOL in the USA ,all DMV are supposed to use one and only one language, ENGLISH, however the whole USA, with two exceptions ALL ignore the law and have multiple languages to choose from.
Congratulations South Dakota and Wyoming, for being the ONLY TWO states that have Licensing departments that will only issue a CDL if you pass in all areas using strictly English.
Someone needs to do whatever it takes to force the DOL's to comply , and stop this war between our justice dept. and the Licensing dept.
A simple sign turned for the EMPLOYEES to read at the DMV might help. .........
Anyone giving a CDL test in any language other than English will be punished to the fullest extent of the law. Or have their programs , tests, etc in English only on the computers. I think that would be SIMPLE.

Gearjammin' Penguin, 201 and Tall Mike Thank this. -
I agree with this man 99%... What he left out was that most of the Non-Domiciled CDL driver's that were supposed to go back "Home" when their "Non Domiciled CDL's" EXPIRED!!! They stayed here!!! In the time they stayed here, they wreaked havoc on our roads. Mr. Roger...I have one question...Why is your default position, to any fatality accident that involves a foreign driver, that wasn't supposed to be here because of a number of reasons, including, they're Non-Domiciled CDL Expired, that your Default answer is "That has nothing to do with it" Why isn't your default reaction in the favor of your fellow American?Last edited: Jul 10, 2026
Magoo1968, Gearjammin' Penguin, Tall Mike and 1 other person Thank this. -
I’ll show you the laws, the cases are all related and support the laws and power.
It starts with the constitution
Article I, Section 8, Clause 3 - "The Congress shall have Power... To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes." This establishes the power of Congress to create laws to regulate interstate commerce.
Department of Transportation Act of 1966 (Public Law 89-670). This creates the U.S. DOT.
49 U.S.C. § 101 - This defines the purposes of transportation policy, including promoting safe, efficient, and accessible transportation.
49 U.S.C. § 311 - establishes the FMCSA and mandates the safety of the road vehicles
49 U.S.C. § 113, which states that the Secretary of Transportation shall exercise duties and powers prescribed by law relating to transportation, including maintaining the safety of the public.
What I am saying is he has the power to suspend all authorities within one state when the state fails to follow the laws and regulations, this is well established in the courts that the power exists, the states have no recourse because when he issues the order to suspend the authorities of a state, the court can’t act on an issue that is constitutionally legal, and has to be addressed without injunction relief. -
And again you are wrong. No such thing as a blanket revocation of all authorities in a state. Only by compliance review of imminent danger.
Try again with it. -
I forgot to add one thing. I think these Non-Domiciled CDL's were never meant to be used the way these foreigners are using them. They were meant for use in the U.S. A driver that lives in Ca. could go to the Prime Academy in Mo. get their license, then drive with a Non-Domiciled CDL until they got back to Ca. to have it changed to a Ca. CDL
Antinomian and JB7 Thank this. -
That is not true.
Non-Domiciled CDL was always intended to give foreigners the privileges of a CDL. Read the actual regulation.
A few dishonest politicians have been repeating that lie. -
This was not the case until recently!
Before Duffy changed the regulations, in June of the year, the federal government encouraged states to administer tests in foreign languages.
The federal government (FMSCA) used to not only allow language interpreters to take the tests with the CDL candidate, but would allow states to fund the whole process with taxpayer dollars.
All states should have suspended foreign language testing by now. -
Everything is.
Unfortunately, we get a lot misinformation due to the political narrative being perpetrated.
This is the chicken and egg argument.
A standard would emerge if the slightest effort was made to enforce the regulations. Just no one has the political willpower to go after an employer, or enforce employment and immigration laws.
Let's be honest, Hellen Keller would convict many of the carriers with a violation of the English speaking clause, without any standard, with the drivers they hire. -
Try again, he has the power when the state does not comply with the regulations. The state do not issue authorities, the federal government does and Congress already gave him a hell of a lot of latitude to ensure the regulations are enforced and the roads are safe. Right now the states are not enforcing the basic licensing requirements and are subject to the actions of the federal government.
