Really need advice on abandonment

    Really need some advice on this one. The company will remain nameless due to possible future legal procedings. The bottom line is they are charging me with truck abandonment. So any advice on what I should do is welcome.

    So heres the backstory. I informed my manager that I needed to turn my truck in because I decided that I would be going back into the military. They wanted me to go to New York. I told him "I dont want to just leave your truck on the side of the road here, what do I need to do turn this in the right way." He then told me "well you have two options, option one is you go to New York and we will get you there to turn in when we can, option two is you take the truck to a secure lot where you are but then you will have to find your own way home, but it would be better for you if you take the New York load." I was empty during this conversation. The wanted me to go south, pick up a load and go to New York. I decided to take the truck to the secure lot. I sent them a message on the qualcomm saying that truck was at the secure lot as instructed. They sent me a reply to call them. After I called them he said, "You dont understand, either you take the New York load or we will charge you for abandonment." I said "Wait a minute, this is your property and you told me this was an option." He then said "No its not a terminal though and you will be charged with abandonment." I said "You didnt say that when I asked you what you wanted me to do. Well then let me take it to terminal." He said "You dont have that option". I said " wait, what do you mean I dont have that option?" He then told another guy to secure the truck, turn the fuel card off and charge me for abandonment and hung up on me.

    I know you here one sided stories all the time but beleive me this is 100% truth, no fabrication, no shortage of facts. So my question I guess is this what can I do to fight this, I mean I have spent years building my "name" up as far as I mean I take pride in what I have done in life and here because one person tried to hardball me my name is dragged through the mud. I will take it to court if need be, this is deformation of character, but I dont care about any of the money or anything, I just want to clear my record.

    Thanks for the websites, I really appreciate the advice. I mean this is absurd, are most truck driving jobs like this or just some...doesnt matter I guess Im done driving but still want the record clean, never like doors closing behind me if you know what i mean

    Yep! Everytime dispatchers want to hide info, they say Call Me.

    I always respond back, I'm out of minutes, just send it across here.

    Then you can take pictures.

    had an accident years ago I was an O/O then leasted to a company out of so. Cal. I was told to dead head from phenix to el'centro well I didn't make it to el'centro. the dispatcher claimed I had done this on my own and that I was not under dispatch thru the company. since then I have used a tape recorder to tape ALL convos with anyone from the company from the dispatcher to the secertary or the mechanic

    welcome to the world of trucking my friend and all trucking compny's do the same thing thing . can you do anything about it sure you can but your going to have to spend some money to get it done your going to have to hire an attorney , but it is an open and shut case.

    there is no law anywhere that says you can't quit your job whenever or where ever you want to that truck abadonment is trucking compay bs it's not hard to beat it all your attorney has to do is show up in court and it's done , however if you don't get that attorney it will stay against you for seven years with a company like dac and the company in question can keep it in your personal file forever, your only choice is to sue them it's not right but that is the way it is . best of luck southernpride

    Don't need pictures. Q'Com transcripts can be subpoenaed.

    Here's a thought. Don't work for a company that you have to consider court filings just to terminate their employment.
